우버 ‘노동자’ 보험·휴가에 쿠팡 ‘노동자 아니다’타격

Uber's “worker” Coupang’s “not a worker"

영국이 우버 운전자 7만여명에게 최저임금과 임금 12.07% 휴가수당 지급에 직장보험 무상 가입을 밝혀 쿠팡의 베달인 ‘독립계약자’로 노동자가 아니라는 상장 보고에 타격이 시작됐다.

쿠팡 김법석 의장은 우버의 최고기술자책임자를 2019년 고액 스톡옵션을 주고 영입해 뉴욕증시 상장에서 ‘쿠팡플렉스·이츠 배달노동자가 근로기준법상 노동자가 아니다’고 명시했고,“쿠팡 플렉스·이츠 배달원을 독립계약자로 분류하는 것이 법령과 법적 해석에서 어려워진다면 이를 방어·해결하는데 드는 비용은 당사의 사업에 중요 요소가 될 수 있다”고 기록했다.

영국 대법원은 우버 운전자에게 일하고 싶을 때 일하고 쉬고 싶을 때 쉬는 ‘개인사업자’가 아니라 사업자에게 종속된 ‘노동자’라며 지난달 19일 우버의 패소를 판결했고, 영국 우버는 16일 “17일부터 최저임금 휴가수당 지급, 직장인 보험 무상 가입”을 공표했다.

쿠팡은 미국 우버 출신 투안 팸 최고기술책임자(CTO)를 2천743만달러 스톡옵션에 2천764만달러(305억원) 보수로 영입해 우버식 플랫폼 배달체계로 ‘활성 고객(active customer)’ 체계에서 배달 노동자를 독립사업자로 뉴욕증시에 신고하며, “한국 노동부가 판정했다”는 명시했고 한국 정부는 ‘판정’에 대한 언론 질의에 답변을 유보했다.

영국 대법원 판결은 우버가 운임 등 계약조건 일방 책정에 승차 거부시 불이익 벌점을 통해 우버가 운전자 통제 경영을 근거로 노동자라며 승객 운행 시간이외 앱을 켜고 대기 시간까지 노동시간으로 판정했다.

쿠팡의 증시보고서는 “한국 고용노동부를 포함한 국내 규제기관은 쿠팡플렉스 파트너와 쿠팡이츠 배달 파트너를 노동자(employees)가 아닌 독립계약자(independent contractors)로 판정했다”고 밝혔다.

쿠팡은 우버 체계를 그대로 적용해 상품 배송을 근로기준법 노동자인 ‘쿠친’(쿠팡맨)과 플랫폼운송자로 양분해 특정일·특정 지역 배송에서 ‘건당 수수료’ 체계 확대에서 ‘쿠팡플렉스 파트너’를 로켓배송의 주력으로 키웠고, 지난해 4분기 매출 확대 주력인 음식 주문·배달원 ‘쿠팡이츠’는 ‘독립계약자’로 상장서류를 작성하며 ‘한국 정부가 판정했다’고 명시했다.

영국 법원은 우버의 음식 배달서비스인 ‘우버이츠’의 배달기사에게는 ‘노동자 지위’를 적용하지 않았다.

Uber's “worker” insurance and vacation pay hit Coupang’s “not a worker”

The UK announced that more than 70,000 Uber drivers were paid a minimum wage and a 12.07% vacation pay and free work insurance.

'Kupang Itz', a food ordering and delivery company, which was the main focus of sales growth in the fourth quarter of last year, wrote a listing document as an'independent contractor' and stated that'the Korean government decided'.
The British court did not apply the "worker status" to the delivery driver of Uber's food delivery service, Uber Eats.
