이재명 비밀평가 강제 평가자 ‘평가배제’ 헌법 ‘정당 조직활동 민주주의’ 위반
이재명 민주당 대표가 비밀 평가 점수에 의한 ‘선출 점수 복종 강제’ 조치에서 평가자의 선행 평가 원천 배제를 통해 헌법 8조 ‘정당’ 조항에서 ‘조직 활동 민주주의 보장시 국고 지원’을 위반했다.
이 대표는 국회의원 후보 선출 브리핑에서 22일 "여러분도 누군가는 1등을 하고 누군가는 꼴등을 할 수밖에 없다"며 23일 “과정을 거쳐 선수 한 명을 선발할 수밖에 없다. 불가피함도 이해하고 수용하길 부탁한다”고 공천 선별 강제 조치를 밝혀 헌법의 8조 ‘정당은 조직 활동 민주주의’ 강제 규정을 위반했다.
이 대표는 국회의원 후보 공천 심사에서 심사관을 비공개했고 심사 결과도 비공개 처리후 결과만으로 ‘순위 매김’을 공개하는 수법으로 ‘조직 활동 민주주의’에 위배를 당연한 정당 권리로 포장했다.
정당 민주주의는 조직 활동에서 민주주의 보장을 법률로 강제하면서 국고에서 ‘재정 지원’ 체제로 국민의 정당 자유로운 정당 참여를 지원한다.
이 대표의 의원 후보자 선출은 중앙당 주도에서 ‘당 기여도’ ‘동료 의원 평가’ ‘권리당원과 국민 평가’의 평가로 '동일가치에 중복 가중' 점수 부여 방식에 의한 서열화를 통해 하위자 탈락시키는 전형적인 ‘심사자’ 임명 권자인 ‘당 대표 독재’ 방식으로 ‘활동 민주주의’를 배제했다.
정당의 ‘조직 민주주의’는 평가자와 평가 대상이 동급으로 권리 의무가 부여돼야 가능하며, 평가자는 공개 활동에서 기준과 적용 정보를 공개하고, 평가자는 정당과 평가 대상자를 넘어 정당 밖에서도 평가 대상이며 선별에 대해서도 평가해야 민주주의 활동에 해당된다.
이 대표의 ‘공천 심사 평가 서열화 복종 강요’는 정당 민주주의에 의해 ‘평가자에 대한 공정한 공개 평가’의 우선 절차의 고의적 삭제와 재심 거부로 확인된다.
민주당 공천관리위원회는 22일 평가 결과에 불복한 박용진·김한정 의원에 대해 회의를 열지 않고 “명백한 하자가 존재하는지 심사 절차를 밟은 결과, 이유가 없다고 판단했다”며 재심 신청을 기각했다.
정당에서 소속 국회의원을 비밀 평가하는 규정 중 '동료 의원 평가'는 현역의원 평가(총 1000점) 중 '다면평가'로 명칭을 포장했으나, 실제는 동료 의원과 당직자 등이 당권에 직접 영향을 받은 후에 평가 점수를 제출하는 항목으로, 당 대표의 주관이 개입할 수 있다.
민주당 인재위원회 간사인 김성환 의원은 22일 인터뷰에서 "되짚어보면 작년 하반기 때 평가했을 수 있다"며 "그 시기가 공교롭게 이 대표 체포동의안에 대한 당 의원들의 가부결 시기 전후가 아닌가 싶다"고 이 대표와 관련성을 직접 언급했다.
이 대표는 22일 브리핑에서 ‘하위 20% 통보’ 반발에 대해 "평가위원 입장에선 불가피하게 점수를 매겨야 하고 등수를 가려야 한다"며 "심사위원 의견도 있지만 동료 의원 평가도 중요한데, 거의 0점을 맞은 분도 있다고 한다"고 밝혔다.
민주당은 국고 보조금을 수령하면서 점수제의 평가위원 명단은 그간 단 한차례도 공개하지 않았고 이번에도 비공개로 민주주의 검증 절차와 조직에서 완전 배제했다.
헌법 제8조는 <②정당은 그 목적ㆍ조직과 활동이 민주적이어야 하며, 국민의 정치적 의사형성에 참여하는데 필요한 조직을 가져야 한다> <③정당은 법률이 정하는 바에 의하여 국가의 보호를 받으며, 국가는 법률이 정하는 바에 의하여 정당운영에 필요한 자금을 보조할 수 있다>는 조항에 이어 <④정당의 목적이나 활동이 민주적 기본질서에 위배될 때에는 정부는 헌법재판소에 그 해산을 제소할 수 있고, 정당은 헌법재판소의 심판에 의하여 해산된다>고 명시했다.
이 대표는 '더민주전국혁신회의' 별도 조직에서 자신과 정진상의 변호사 3인에 '가산점 부여' 공천을 주고 영입인재에 변호사를 '기후전문가' 등으로 포장해 공천 경선권을 주고 그 대표를 서울 은평을에 공천한 반면, "2023년 특별당규에 의한 시스템 공천이다"고 기자들에게 말했다.
이 대표는 2022년 7월 29일 "저학력, 저소득층이 국민의힘 지지가 많다"며, 앞서 민주당 토론회에서 “나는 기득권에 빚진 게 없어 지금도 모든 영역의 기득권으로부터 총공격 당한다”고 민주당 기득권층 제거를 밝혔다.
