트럼프 법무부 DNI에 ‘보수주의에 형사사법 부당사용 제3세계 검찰 무기화’ 조사
트럼프 대통령 취임에서 ‘연방정부 무기화 종식’을 선언하고 종식을 위해 자신의 행정명령으로 범무부에게 정부기관과 정보기관 금융기간들에 대한 무차별적인 정치편향 조사와 보고를 지시하며 공화 민주 양당 체제의 ‘행정명령 전투’가 제3국으로 확대가 시작됐다.

<연방정부 무기화 종식> 행정명령은 "바이든 행정부와 전국의 동맹국들은 민주적 절차를 뒤엎기 위해 전례 없는 제3세계 검찰 권력 무기화에 가담했다"고 밝혀, 한국의 윤석열체제 탄핵이 그 대상으로 보인다.
<연방정부 무기화 종식>은 미국에 국한되지 않고 바이든 체제가 대외 전략으로 만든 한미일 3국 동맹 등을 겨냥한 것으로 보이는 "바이든 행정부와 전국의 동맹국들은 민주적 절차를 뒤엎기 위해 전례 없는 제3세계 검찰 권력 무기화에 가담했다"는 조항을 별도로 명시했다.
공식 명칭이 <연방정부의 무기화 종식> 제목에서 트럼프 대통령의 1호 행정명령은 “보수주의자들에 대해 형사사법제도를 부당하게 사용해왔다”는 것이 핵심이고, 트럼프 대통령은 4년 간 지속적으로 자신과 자신에 대한 지지자들이 보수주의자들이고 이에 대한 ‘형사사법제도 부당 사용’을 처벌해야한다고 주장해 왔다.

클린턴 대통령은 공화당 강경보수의 ‘마약전쟁’ 등으로 공권력 강화에서 발생한 로드니킹 흑인에 대한 백인 경찰 집단 구타 사망에서 ‘경찰내규’에 의거해 무죄가 선고되고 즉시 폭동으로 번졌고 이로 공화당 보수체제가 민주당으로 넘어 온 직후 ‘경찰내규가 아닌 법률에 의거해 유죄 선고’가 나왔다.
트럼프 체제의 첫 날 ‘행정명령’에 대해 뉴욕타임스는 “법무부 감찰관이 종종 수행하는 것과 같은 종류의 윤리 조사나 검찰이 실시하는 범죄 수사 등 어떤 유형의 검토가 수행될 것인지를 불분명하게 하고 있다”며 트럼프 대통령이 공식 발표한 "전임 행정부가 미국 국민에 대해 연방정부를 무기화한 것에 대한 책임을 묻겠다"는 ‘책임 목표’가 무엇을 의미하는지도 모호하다고 평가했다.
NYT는 이어 “이 문건의 문언은 트럼프 행정부의 검토가 트럼프 대통령을 상대로 소송을 제기한 맨해튼이나 조지아주 풀턴 카운티의 지방검사, 뉴욕 검찰총장 등 지방검사나 주 공무원들의 행위를 조사할 것임을 시사하고 있다”며 “대통령령은 법무부가 2021년 1월 6일 의회 복도에서 일어난 폭동과 관련된 혐의로 1,500명 이상을 ‘무자비하게 기소했다’고 비난했다”고 20일 밝혔다.
트럼프 대통령은 취임 연설에서 미국 정부가 "우리의 훌륭하고 법을 준수하는 미국 시민들을 보호하지 못하고, 전 세계에서 우리나라로 불법 입국한 교도소와 정신병원에서 온 위험한 범죄자들에게 피난처와 보호를 제공하고 있다"고 말했다.
AP는 이를 ‘거짓말’이라며 사실에 대해 <다른 나라들이 범죄자나 정신 질환자를 국경 너머로 보내고 있다는 증거는 없다>며 <트럼프는 가장 최근의 선거운동 기간 동안 이 주장을 자주 제기했다>고 20일 보도했다.

해리티지재단 아시아센터 에드윈 퓰너 회장은 조언에 대해 “윤 당선인이 2년 여소야대 상황 극복을 말해, 미국 대통령은 의회 동의없이 행정명령을 발동할 수 있다. 그런 식으로 할 수 있으리라 믿는다”며 “첫째 의견이 일치하는 인물들로 참모진 구성해야 하며 자신과 뜻이 맞는 사람을 찾고 이런 사람들을 발탁해야 한다고 조언했다. 전략이란 뜻은 당신이 가고 있는 방향을 정확히 알고 목적에 초점을 맞추고 원하는 곳으로 가는 것이다. 전략적 모호성은 모순이고 제대로 작동하지 않는다. 가야 할 방향을 정하고 거기에 맞는 사람 발탁해야 한다”고 밝혔다.
헤리티지재단은 트럼프 재선 운동에서 ‘프로젝트 2025’ 보고서로 강경보수 복원의 행정부 개편 전략을 펴냈고, 이사장이 비서실장 후보로 올랐다가 탈락했다.
헤리티지재단은 1980년 강경보수의 레이거노믹스 전략에서 보수주의 전략으로 공개 정책 무력화를 이끌었고 한국의 전두환체제와 강경보수 체제 정당 지원 전략에 지속 관여했다.
케빈 로버츠 헤리티지재단 회장은 지난해 7월 3일 "지난 25년 동안 대부분의 정치적 폭력은 좌파에 의해 시작됐다"며 트럼프 대선 승리에서 공화당의 "야심찬 정책 계획"으로 ‘연방정부내 우파 반대 공무원 축출’에 관한 ‘프로젝트 2025’의 연방정부 전면 개편을 발표했고, 이는 트럼프 체제 행정명령으로 나타났다.
로버츠 헤리티지재단 회장은 이어 7월 17일 성명에서 미국인들이 "엘리트와 독재적 관료들로부터 권력을 되찾기 위해 제2차 미국 혁명을 수행하는 과정에 있다"며 "이 애국자들은 투표함에서 평화 혁명을 위해 헌신하고 있으나 불행히도, 좌파는 오랜 폭력의 역사를 가지고 있기 때문에, 평화적인 권력 이양을 허용하는 것은 그들에게 달려 있다"고 밝혔다.
로버츠 회장은 이어 2020년 경찰이 조지 플로이드를 살해한 이후 벌어진 LA시위들을 언급하며 "일부는 범죄, 기물 파손 및 폭력으로 분출했다”라며 지지자 대선 패배 강제 전환 점거 폭력이던 2021년 1월 6일 의사당 폭동을 아예 “민주당이 공화당 의원들을 폭력 혐의로 비난했다”고 비난했고, 이를 윤석열 지지파 의원들이 판결 뒤집기의 법원 난입 폭동을 ‘경찰 과잉 진압’ 비난 모방으로 일치시켰다.
의사당 난입에서 민주당의 낸시 하원의장의 방을 집중 침탈 파괴하고 책상에 다리를 올려 사진을 찍은 사건에 대해, 한국에서 법원 영장 발부 판사 방을 찾아가 집중 파괴하는 모방을 보인다.
트럼프 대통령은 취임 무도회에서 평택 캠프 험프리스의 주한미군 장병들과 영상 통화로 "김정은은 어떻게 하고 있냐. 한국이 지금 어떻게 되어가고 있는지 물어봐도 되냐"라면서 "여러분들은 매우 나쁜 의도를 가진 누군가를 대하고 있다. 내가 비록 그와 매우 좋은 관계를 발전시켰지만, 그는 거친 놈(cookie, 폭탄)이다"고 첫 군통수권 행사로 북한을 선택했다.

On April 28, 2018, Chairman Feulner of the Heritage Foundation, who was closely involved in Trump’s re-election strategy, advised him to “appoint people you like even if they are biased” and “neutralize the majority party in the National Assembly with an executive order” at his Seocho-dong apartment, and they met three more times after that.

The Heritage Foundation presented a strategy for reorganizing the administration to restore hard-line conservatism in the ‘Project 2025’ report during Trump’s re-election campaign, and the chairman was nominated as the chief of staff but was eliminated.
