한국 정부와 한수원이 체코 법원의 체코원전 계약 중지명령을 거부하고 체코 기업들과 9건을 미래 계약하고 3개 양해각서를 체결했다.
한국수력원자력(KHNP) 입찰을 추천하는 입찰 과정을 진행한 엘렉트라르나 두코바니 II(Elektrárna Dukovany II) 프로젝트 회사의 원자력 발전소 운영사인 체코의 원자력 발전소 운영업체 CEZ는 X에 양측간의 계약 체결에서 한국 안덕근 산엄장관이 중앙에 선 단체 사진을 40여장 게제했다.
한수원은 6일 ‘미래계약’ 체결 이후 7일 성명으로 "체코의 법적 절차를 존중하고 모든 관련 법률과 규정을 성실히 준수할 것"이라고 밝혔다.
한수원은 성명에서 이어 “입찰 과정이 공정하고 투명하며 합법적으로 진행됐다"며 "입찰 결과를 훼손하려는 경쟁사의 지속적인 시도에 대해 매우 유감스럽게 생각한다"고 밝혔다.
피알라 체코 총리는 8일 홈페이지에서 한수원과 CEZ간에 대해 “계약 체결을 승인했으며, 법원의 허가가 나는 즉시 계약을 진행할 준비가 돼 있다”고 밝혔고, 한수원은 CEZ와 계약없이 하청의 체코 기업들과 계약을 6일 연속 체결해 원청 불발시 손해배상에 걸린다.
안 장관은 체코 법원의 공공조달법 적용을 회피하기 위해 한국 기업이 체코 하청 기업과 계약 체결을 우선 보장해, CEZ 계약 불발시 한국의 계약은 공공조달의 보호 장치없이 국제적 분쟁을 초래할 것으로 보인다.
체코의 주관회사인 CEZ는 법원의 판결에 프랑스의 가처분 요구 기각 요청 사유로 "우리는 이 경우 민간 기업의 상업적 이익이 체코 시민을 위한 충분한 전기와 국가의 에너지 안보를 보장하는 공공의 이익보다 확실히 더 크지 않다고 확신한다"며 ‘에너지 안보가 공공이익’이라 주장했으나, 법원은 ‘법률 준수와 사법 심사 이익이 더 크다’는 사유로 ‘중지’ 결정했다.
체코는 공공계약 행정 규약에서 ‘원청 기술’을 필수 조건으로 명문화했고, 한수원은 웨스팅하우스와 ‘비밀협약’으로 지적재산권에 대한 밀거래를 통해 웨스팅하우스의 항소 취하는 따낸 것이 프랑스 DDF의 법원에 계약 중지 가처분 소송에 영향을 끼친 것으로 보인다.
세계원자력뉴스(WNN)은 “한국과 체코 기업들은 두코바니에서 계획된 새로운 원자력 발전소와 관련하여 9건의 계약과 3건의 양해각서에 서명했다”며 “두 회사 간의 계약 및 합의 서명은 6일 프랑스 EDF가 체코 공화국의 우선 입찰자인 한국수력 및 원자력(KHNP)과의 신규 발전소 계약 체결을 금지하는 법원 명령에도 불구하고 이루어졌다”고 7일 보도했다.
체코 통상산업부 장관 루카스 블첵(Lukas Vlcek)은 이날 "현 시점에서 법원의 판결 직후 우리가 할 수 있는 모든 것을 하는 것이 중요하다. 이것이 바로 오늘 한국수력원과 한국대표팀 구성원 간에 다수의 상업 협정 및 협력 협정이 체결된 이유이다“며 "계약 체결은 우리가 새로운 원자력 발전소 건설에 대해 진지하다는 분명한 증거이며, 9건의 ‘미래 계약’에 대한 계약 체결과 3건의 각서가 체결돼 프로젝트의 준비 상태와 체코 기업의 구체적인 참여(현재까지 30%, 건설 말기까지 60%)를 확인했다”고 밝혔다.
체코원전은 한국의 입찰조건에서 60% 체코 기업 참여 보장이고, 이에 대해 ‘미래계약’으로 이날 한수원이 안덕근 장관의 보증으로 체코 기업들과 사전 계약을 맺은 것으로 보인다.
WNN은 한국이 체결한 이날 계약에 대해 "터빈 홀 공급에 대한 기본 계약과 Škoda Power, KHNP 및 두산 간의 증기 터빈 계약이 포함됐다“며 ”체코 기업들인 Škoda JS, ÚJV Řež, Metrostav DIZ, ZAT, OSC, I&C Energo, NUVIA 및 건설 기업가 협회(Association of Construction Entrepreneurs)와 다른 중요한 협정을 체결했다“고 밝혔다.
체코 통상장관은 이날 "건설에 대한 체코 산업의 30% 참여는 이미 보장됐고 목표는 여전히 60%이다“며 ”우리는 가능한 최고의 파트너를 선택했고 두코바니 프로젝트는 에너지, 안전 및 산업의 관점에서 전략적이며 우리는 가능한 한 빨리 건설 과정을 계속할 준비가 되어 있다"고 밝혔다.
CEZ는 X에 안덕근 장관의 사진 등을 올리며 설명으로 "두코바니의 새로운 원자력 발전소 건설은 체코의 에너지 안보와 자급자족을 위한 중요한 프로젝트이다. 체코 가정과 체코 경제는 삶의 질, 번영 및 체코 산업의 경쟁력을 유지하기 위해 저렴한 가격으로 충분한 에너지를 사용할 수 있다는 확신을 가져야 한다."고 밝혀, 한국이 보증하는 사업으로 밝혔다.
체코 지방법원의 가처분 판결은 한국 대표단이 이미 체코를 방문하고 있는 가운데, 6일 계약 체결을 금지하는 명령을 냈다.
브르노 지방법원은 한국 회사를 선정하는 데 사용된 과정에 이의를 제기하는 EDF의 사건이 완전히 심리될 때까지 지속되는 금지 명령이 "원고(EDF)가 ... 만약 계약이 체결된다면, 법원이 소송에서 프랑스에 유리한 판결을 내린다 하더라도, 프랑스 입찰자는 공공 계약을 따낼 수 있는 기회를 돌이킬 수 없을 정도로 잃게 될 것이다"고 계약 금지 명령을 발표했다.
브르노 지방 법원은 웹사이트에 올린 성명에서 이번 판결에 대해 "이는 중대한 공공 계약이다. 법원은 이 판결이 두코바니의 새로운 원자력 발전소 건설이 지연될 경우 발생할 수 있는 부정적인 결과를 초래할 것임을 알고 있다. 그러나 이러한 것들이 법률을 준수하고 효과적인 사법 심사를 보장하는 이익보다 더 중요하지는 않다"고 게약 중지 명령 이유를 밝혔다.
법원은 특히 “이 주장의 ‘심각성과 장점에 대한 예비 평가’를 받았다‘면서 ”EDF는 체코 경쟁 사무국이 입찰 과정이 수행된 방식에 대한 검토를 수행할 권한이 없다고 판결한 것에 이의를 제기했다“고 밝혔다.
웹싸이트 성명은 "브르노 지방법원은 이러한 접근법에 대한 원고(EDF)의 주장이 적절하고 상대적으로 강력하다고 평가하여 예비적 금지 명령을 내렸다. 그렇다고 해서 원고가 차후의 법적 절차에서 승소할 것이라는 의미는 아니다. 법원은 추가 사항, 소송 당사자의 반응 및 행정 파일에 대해 알게 되면 소송의 장점에 대한 예비 의견을 변경할 수 있다"고 부가 설명했다.
법원의 판결 이후 페트르 피알라 체코 총리는 SNS를 통해 "우리는 독립 법원의 판결에 주목한다. 당사는 입찰 평가 과정이 공정하게 관련 법률에 따라 수행되었다고 확신한다. 공급업체를 선정할 때 가장 중요한 요소는 시민과 기업을 위한 합리적인 가격의 전기 가용성과 최상의 보증이었다. 법원이 모든 맥락과 위험을 알고 있으며 신속하게 결정을 내릴 것이라고 믿는다"고 밝혔다.
법원 결정에 앞서 체코 원자력 발전소 운영업체 CEZ는 Elektrárna Dukovany II 프로젝트 회사가 "모든 단계에서 완전히 투명한 방식으로 완전히 공정한 조건에서" 입찰을 수행했다고 밝혔다.
CEZ는 이어 “처음부터 이 절차가 소위 보안 예외 조항에 속하게 될 것이 분명했으며, 국제 전문가, KPMG 및 경쟁 사무국이 모두 이 절차에 동의했다”면서 "우리는 이 경우 민간 기업의 상업적 이익이 체코 시민을 위한 충분한 전기와 국가의 에너지 안보를 보장하는 공공의 이익보다 확실히 더 크지 않다고 확신한다"고 밝혔고, 법원은 이를 받아들이지 않고 ‘사법 심사 보장 이익이 더 중요하다’고 판결했다.
CEZ는 이어 프랑스 EDF 이의에 대해 "우리는 KHNP의 제안이 EDF가 제출한 제안보다 모든 매개변수에서 체코에 더 유리하다고 주장한다. 이에 대해 의심의 여지가 없도록 EDF가 제안을 즉시 공개할 것을 촉구한다"고 밝혔다.

South Korea refuses Czech court's order to suspend contracts, signs 9 future contracts and 3 MOUs with Czech companies
The South Korean government and Korea Hydro & Nuclear Power (KHNP) refused a Czech court's order to suspend contracts for the Czech nuclear power plant and signed 9 future contracts and 3 MOUs with Czech companies.
CEZ, the Czech nuclear power plant operator of the Elektrárna Dukovany II project company that recommended the Korea Hydro & Nuclear Power (KHNP) bid, posted about 40 group photos of the contract signing between the two parties on X, with South Korean Minister of Trade, Industry and Energy Ahn Duk-geun in the center.
After signing the 'future contract' on the 6th, KHNP announced in a statement on the 7th, "We will respect the Czech legal procedures and faithfully comply with all relevant laws and regulations."
KHNP continued in the statement, saying, "The bidding process was fair, transparent, and legal," and "We deeply regret the continued attempts by competitors to undermine the bidding results." CEZ, the Czech lead company, argued in the court’s ruling that “we are convinced that in this case the commercial interests of private companies do not outweigh the public interest in ensuring sufficient electricity for Czech citizens and the energy security of the country,” and that “energy security is a public interest,” but the court ruled to “suspend” the contract, citing “the interests of compliance with the law and judicial review as greater.”

The Czech nuclear power plant guarantees 60% Czech companies’ participation in Korea’s bidding conditions, and it seems that Hanwha signed a preliminary contract with Czech companies on this day as a ‘future contract’ with Minister Ahn Duk-geun’s guarantee.

It stated that it is a project guaranteed by Korea.
The injunction of the Czech District Court was issued on the 6th while the Korean delegation was already visiting the Czech Republic, prohibiting the signing of the contract.
The Brno District Court announced the injunction, which will last until the full hearing of EDF's case challenging the process used to select the Korean company, saying, "If the contract is signed, the French bidder will irrevocably lose the opportunity to win the public contract, even if the court rules in favor of France in the lawsuit."
The Brno District Court said in a statement on its website that the ruling “refers to a major public contract. The court is aware that this ruling could have negative consequences if the construction of the new Dukhovany nuclear power plant is delayed. However, these do not outweigh the interests of ensuring compliance with the law and effective judicial review,” explaining the reason for the injunction.
The court specifically stated that it had “preliminary assessment of the seriousness and merits of the claims” and that “EDF objected to the ruling that the Czech Competition Authority had no authority to conduct a review of the way the tender process was conducted.”
The website statement said that “the Brno District Court found the plaintiff’s (EDF) arguments against this approach to be adequate and relatively strong and granted the preliminary injunction. This does not mean that the plaintiff will succeed in future legal proceedings.” The court may change its preliminary opinion on the merits of the case after learning of additional facts, the parties' reactions and the administrative file," the statement added.
After the court's ruling, Czech Prime Minister Petr Piala said on social media: "We take note of the decision of the independent court. We are convinced that the tender evaluation process was conducted fairly and in accordance with the relevant laws.
The most important factors when selecting suppliers were the availability of electricity at reasonable prices for citizens and businesses and the best guarantees. “We believe that the court is aware of all the context and risks and will make a decision quickly,” it said.
Ahead of the court’s decision, Czech nuclear power plant operator CEZ said the Elektrárna Dukovany II project company had conducted its bid “in a completely transparent manner and on completely fair terms at all stages.”
CEZ added that “it was clear from the beginning that this procedure would fall under the so-called security exception, and the international experts, KPMG and the Competition Office all agreed on this procedure,” and that “we are convinced that in this case the commercial interests of the private company clearly do not outweigh the public interest in ensuring sufficient electricity for Czech citizens and energy security for the country.”
The court rejected this, ruling that “the interests of ensuring judicial review are outweighed.”
CEZ then responded to the French EDF objection by saying, “We argue that KHNP’s proposal is more advantageous to the Czech Republic in all parameters than the proposal submitted by EDF.”
