선관위 선거당일 ‘투표하라’ 가두방송 ‘선관위법 위반’

투표율이 당락 예측에 민감한 선거일에 선관위가 오후 차량 운행으로 ‘투표하라’ 가두 방송해 선거관리위원회법 위반을 보였다.

위원회 직무(3조)는 ‘선거관리위원회는 법령을 성실히 준수함으로써 선거 및 국민투표의 관리와 정당에 관한 사무의 처리에 공정을 기하여야 한다’고 적시해 유권자에게 ‘투표 하라’고 가두 방송한 것은 이의 위반에 해당된다.

위원회 직무 조항에 명시된 ‘국민투표에 관한 사무’에서 벗어난 선거일의 선관위 차량대여 ‘가두 투표 독촉’ 방송은 투표율이 높은 후보에 유리하도록 유도하는 정치 행위로 보인다.

김종인 전 국민의힘 총괄선대위원장은 9일 "투표율에 따라서 출구조사 안 봐도 대략은 짐작할 수 있다"며 "사전투표율이 높았다는 것은 후보들에 대한 적극적인 지지층들이 투표했다고 봐야 한다. 오늘 본 투표율이 얼마만큼 되느냐에 따라 상황을 달리 판단할 수 있을 것"라고 투표율과 당락 관계를 설명했다.

선관위법은 ‘경비’ 조항에 ‘국민투표의 준비ㆍ실시ㆍ결과자료정리ㆍ계도ㆍ홍보 및 단속사무에 필요한 경비’만 지원하도록 규정해 ‘투표하라’ 가두방송은 ‘공정관리’ 직무에서 ‘투표 강요’라서 ‘계도 홍보’ 범위를 벗어났다.

선관위법 14조는 ‘선거관리위원회의 위원ㆍ직원은 직무수행중에 선거법위반행위를 발견한 때에는 중지ㆍ경고 또는 시정명령을 하여야 하며, 그 위반행위가 선거의 공정을 현저하게 해치는 것으로 인정되거나 중지ㆍ경고 또는 시정명령을 불이행하는 때에는 관할수사기관에 수사의뢰 또는 고발할 수 있다.

선관위원 해임 사유는 1항이 ‘정당에 가입하거나 정치에 관여한 때’로 규정됐다.
