미국 법무부가 정부 요원의 상호감시를 강화하는 반면 한국 법무부는 검사의 정보수집 권한을 강화하는 인사검증 체제를 주도하게 된다.

미 법무부는 18 년 만에 처음으로 무력 사용 견제 정책을 업데이트하여 연방 요원들에게 다른 법 집행 공무원이 과도한 무력 사용을 볼 경우 개입 할 의무가 있다는 법무부 지침을 지난 월요일에 연방 법 집행 요원들에게 배포했다고 워싱턴포스트가 보도했다.

메릭 갈랜드 법무장관의 새 정책은 ‘공권력’의 과잉 행위에 대해 ‘내부 조례’ 위반 여부를 적용하던 체제에서 인권 침해에 대한 정부의 책임 범위를 넓히고 공무원의 행정집행에 내부 감시체제를 확대했다.

반면 윤석열 체제의 법무부는 인사정보관리단에 검사와 경찰이 인사정보를 통해 인사검증하는 새 체제를 도입했다.

법무부와 인사혁신처, 행정안전부가 24일 대통령령으로 '공직 후보자 등에 관한 정보의 수집 및 관리에 관한 규정' 등의 일부 개정령안을 입법예고했다.

대통령실은 이에 "미국의 선진적인 인사 검증 시스템과 인사정보관리단 시스템이 일정 부분 유사한 측면이 있다"고 연합뉴스에 25일 밝혔다.

미국은 백악관 법률고문실에서 의뢰받은 공직 후보자에 대해 후보자가 제출한 본인 기록 서류와 이력을 독립적 FBI(연방수사국)가 범죄 관련에 대해 상호 검증한 결과를 내놓고 이를 통해 백악관이 결정해 발표한다.

윤석열 체제 법무부는 신설된 인사정보관리단에 검사와 경찰이 주도하에 ‘사회분야’(1담당관) ‘경제분야’(2담당관)이 정보수집과 분석결론을 모두 담당한다.

대통령 최측근인 장제원 의원(전 비서실장)은 25일 페이스북에 “국정원에도 인사검증 부서를 정식으로 두면 좋을 것”이라며 “윤 대통령이 다양한 채널을 통해 인물에 대한 평판을 들어보길 원했다”고 올려, 인사검증이 정보기관 주도 정보수집 의존을 강화했다.

법무부 인사정보관리단은 대법원장을 비롯한 법원 인사와 국무총리와 행정부는 물론, 국정원 및 3군 군사조직 인사를 총괄하면서 ‘검사의 정치적 중립’과 ‘법원 독립’을 훼손할 것으로 보인다.

대통령령이 통과되면 인사혁신처의 공직 후보자에 관한 개인정보 수집·관리 권한이 대통령비서실장 까지 포함해 법무장관에게 위탁되며, 법무부령에 따라 법무장관 직속 인사정보관리단장(검사 또는 고위공무원)이 요원 20명(검사 최대 4명, 경정급 경찰 2명 포함)에 2담당관(경제)은 검찰수사서기관이 지휘한다.kimjc00@hanmail.net
