KBS가 배우 고 이선균의 통화보도 이유로 ‘마약 중대범죄 당사자’로 규정해 사건 연루 제보에서  범죄인으로 취재를 통해 ‘낙인’한 것이라서 인권침해를 보인다.

박희봉 KBS 보도본부 사회부 팀장은 “해당 사안은 마약 남용이 공중보건과 사회 질서에 큰 영향을 끼치는 중대 범죄라는 점, 유명 연예인이 연루돼 사회적 관심이 큰 사안이라는 점에서 언론이 실체를 규명할 필요성이 컸다고 판단했다”고 ‘TV비평 시청자데스크’에서 지난달 10일 밝혔다.

KBS ‘뉴스9’은 지난 11월24일 이선균과 유흥업소 실장 간의 통화 내용을 단독 보도했다. KBS 보도는 혐의와 무관한 사적 대화까지 보도했고 이후 여러 언론이 이 사적 대화를 제목에 부각해 기사를 냈고, 보도를 통해 이선균과 마약 범죄인인 실장을 동일하는 ‘당사자’로 규정했다.

방통심의위는 지난 28일 KBS의 해당 보도에 대한 민원이 접수됐다고 밝혔다.

윤석열 정부는 ‘마약전쟁’은 추진했고 KBS는 경찰이 ‘마약복용’에 증거 부족이 지속되자 ‘제보수사’에 공개 소환 체제에서 대중의 마약전쟁지지 강화 소재로 ‘중범 마약 수사권 남용’ 공조를 보인다. 

마약 제보사건에서 가해자와 피해자의 판단 이전에 언론사가 '범죄 가담자'로 분류한 취재원 미공개 보도는 반론 취재 자체가 '가담자 증거 강화'로 추가돼 언론조작에 해당된다.

이선균이 마약 복용을 시인하지 않은 상태에서 KBS가 범죄자와의 '통화'에 대해 반론을 요구해 이선균이 '통화 사실 시인'의 기사 팩트로 제공 유인한 것이 언론조작이다.

마약 제보 수사에서 이선균 통화자인 유흥업소 실장은 '제보자 마약제보'로 구속됐고, 애초 제보에서 이선균의 마약 관련 증거는 제출되지 않은 것으로 알려져 '마약 제보'와 이선균은 '중거'에서 분리된 상태로 출발했다.

KBS는 지난 11월 24일 이선균 사건 보도 당시 ‘수사에서 피해자 신분’과 ‘사건 연루자’에 해당됐고, 이를 ‘범죄 당사자’로 뒤바꿔서 사적 통화를 보도한 것으로 밝혀, 고의적 인권침해와 명예훼손을 보인다.

제보수사에서 제보자와 직접 관계와 제보 증거가 없는 간접 관계자인 이선균은 유흥업소 실장에 국한된 범죄 혐의에서 간접 관계를 직접 관계로 변조하기 위해 '사적 통화'를 공중파에 보도해 수사권 강화를 공조한 방식이다.
