민주당 당규가 ‘경선 결정자 탈락 후 후보선출’에 대해 이재명 대표가 ‘경선 차점자가 선거 패자’로 임의 판정하고 규칙을 독점해 강령의 ‘공천과정 시민 당원 참여 보장’과 총선 10대 공약인 ‘민주주의 강화’을 위반했다.

이 대표는 후보 경선에 대해 16일 ‘경기 승부에 차점자 우승은 없다’며 “선거에 승자와 패자만 있다” 규칙을 새로 공직후보 선출에 임의 적용했고, 이는 정당 강령의 <당의 의사결정과 공천과정에 더 많은 시민과 당원의 참여를 보장한다> 규약 위반으로 보인다.

민주당 당헌은 ‘3절 후보자 추천’에서 88조가 <②후보자가 단수로 선정된 때에는 최고위원회의 의결 및 당무위원회의 인준으로 추천이 확정된다>와 <③후보자가 2명 이상으로 선정된 때>만 규정해 ‘추천 후보자 탈락’ 규정이 없어 ‘탈락자이후 선정’은 최고위의 권한이 아니다.

이 대표는 이날 기자들에게 “선거법 위반으로 승자가 당선 무효화 돼도 차점자가 당선자가 되지 않는다”며 “박 의원에 대해서는 새벽 1시반이 넘도록 고민에 고민을 거듭해 제3의 인물 전략 공천, 2위 후보를 후보로 결정하는 방법, 경쟁해 다시 후보를 뽑는 방법을 놓고 판단한 것”이라고 최고위 결정이 당령 당규을 배제하고 ‘임의 결정’을 시인했다.

이 대표는 당내 후보자 경선을 국민의 투표권에 의한 선거 결과와 같다는 입장을 보이고, “이해찬 상임 공동선대위원장이 선거에는 승자와 패자만 있지, 2등은 없다고 조언해 그 말에 일리가 있어 그런 안은 배제했다”고 최고위의 패쇄적 운영을 공개했다.

이 대표가 이해찬 전 대표와 공조한 ‘공천자에 선거법 적용’은 선거법에 명시 조항을 따른 것으로, 민주당의 강령에서 '규정에 없는 경선 우승자 탈락’과 완전히 다르다.

정당의 후보자 경선은 당내 경쟁이후 공직선거에서 지지 확대가 목적이라서 차점자가 정당 민주주의의 기준을 보인다.

정당 민주주의는 ‘경선규칙’에 없는 사례가 발생하면 강령에 의거해 ‘공천과정에 시민 당원 참여 보장’이 적용된다.

민주당의 <공직선거 후보자추천 및 선출직공직자 평가위원회 규정>은 <제2조(중립유지 및 공정의무)>에서 <이 규정에서 정하고 있는 직무를 수행하는 자는 선출직공직자 추천심사 및 평가에 영향을 미치는 일체의 부정한 행위를 하여서는 아니 되며, 직무를 공정하게 처리해야 한다>고 ‘추천 심사 평가에 부정행위자 처벌’을 명시했다.

더불어민주당의 이번 총선 10대 공약은 ▲민주주의 회복 ▲정치개혁 등으로 12일 발표했다.
