이재명 성남유세장 기자회견 마이크 ‘왜 와 하세요’ 선거법 '위반'  

   

이재명 대표가 유세장에 유세와 기자회견 병행으로 마이크를 사용하며 ‘박용진 투표결과’ 당원 투표 결과가 공표돼 선거법 위반을 보인다.

이 대표는 19일 강북을 당원 투표 결과를 기자회견으로 직접 발표하며 득표율까지 상세하게 공개했고, 자리에 있던 유세장 지지자들이 환호하자 “왜 와 하세요. 진 사람도 있는데”라고 말해 공직선거법 위반을 보인다.

공직선거법 제59조 4항에 따르면 선거운동 기간 외에는 확성기를 사용하여 선거운동을 할 수 없다고 규정됐고, 이 대표는 유세장에서 기자회견에 청중들이 들리도록 마이크 사용해 내용 공표 방식을 반복 사용했다.

민주당 당헌은 89조에 <③후보자가 2명 이상으로 선정된 때에는 후보자 및 경선방법에 대한 최고위원회의 의결과 경선을 거쳐 최고위원회의 의결 및 당무위원회의 인준으로 추천이 확정된다>고 의결 확정이전에 이 대표가 공표해 이는 ‘선대위 위원장’ 직위를 이용해 ‘당 대표로 기자회견’을 악용한 것이 된다.

이 대표는 19일 성남시 모란오거리 광장 유세에서 기자들에게 “강북을 선거결과는 제가 차를 타고 오면서 보고 받았는데, 가산 감산 없이 해당 지역 권리당원들은 53% 정도 투표를 했는데, 조수진 후보가 훨씬 많이 이겼다고 한다”며 “북을 권리당원 투표 결과는 조수진 후보가 53.76% 박용진 후보가 46.25%였다고 한다. 전국 권리당원은 박용진 후보가 23.15%, 조수진 후보가 76.86%였다. 가·감산이 없어도 박용진 후보가 30.08%, 조수진 후보가 69.93%이었고, 가·감산을 반영하면 19.4%대 80.6%였다고 한다”고 경선 결과를 상세하게 발표했다.

이 대표 발언은 3인 공동선대위에서 대표권을 행사한 것으로, 비공개 경선에서 확정이 이전 단독 정보 입수에 의해 선대위를 부정한 것이 된다.

이 대표 이날 기자회견이 열성 당원을 배경으로 박영진 사태에서 '국민 50% 지역 당원 50% 경선' 체제에 도전하면 '전국 당원 70% 지역 당원 30%' 진압 체제 선언으로 보인다.

이 대표는 이날 기자회견에 대해 국민일보는 <기자회견을 하기 전 취재진에게 “혹시 강북을 선거 결과가 궁금하지 않으냐”며 이례적으로 두 후보의 경선 득표율을 언급했다>고 밝혔다.이 대표는 이어 일부 지지자들이 ‘와’ 하고 환호하자 그는 “왜 ‘와’(라고) 하세요? 진 사람도 있는데”라고 웃으며 말했다.

이 대표는 15일 울산 시장 유세에서 기자들의 양문석 후보 '불량품' 질문에 "여러분 반갑다. 긴 시간 함께 해줘서 고맙다. 울산 시민 여러분들이 잊지 말고 행동해 윤석열 정권의 무도한 폭정을 멈춰달라"고 시민들에 대한 답변으로 대신했다.

이 대표는 17일 양문석 후보의 추가 막말 질문에 “수없이 말씀드렸으니, 이제까지 드린 말씀으로 대신하겠다”며 “기준이 동일해야 한다. 잣대는 같아야 한다”고 기자들에게 답변했다. 

민주당 당헌은 제98조(추천선거)에서 <①공직선거 후보자는 경선을 통해 추천 원칙>으로 <②지역구국회의원선거후보자 추천 경선은 국민참여경선(여론조사경선 포함)> 원칙에 <국민참여경선은 권리당원과 권리당원이 아닌 유권자를 대상으로 하여 투표 또는 조사결과를 반영>과 <권리당원 투표·조사결과는 100분의 50 이하, 권리당원이 아닌 유권자의 투표·조사결과는 100분의 50 이상 반영>을 명백히 규정했다.

이 대표는 유세장 기자회견으로 지역 공직자 후보 선출에서 ‘지역 권리당원’에 ’전국 당원 권리 70%‘ 추가를 추인했고, 당규는 ’선출직공직자평가위원회‘에 <구성과 운영, 평가기준 선정, 평가실시>를 규정으로 부여했다.

민주당 당규 10호 <공직선거 후보자추천 및 선출직 공직자평가위원회 규정>는 <제3조(비밀유지 의무) 이 규정에서 정하고 있는 직무를 수행하는 자는 직무상 취득하게 된 비밀을 누설하거나 당의 보안자료 및 기밀자료를 사적인 용도로 사용하거나 외부 기관 등에 유출하여서는 아니 된다>고 규정해 이 대표는 대표로 취득한 ‘비공개 조사 결과’ 공표로 당규 위반을 보인다.kimjc00@hanmail.net

According to Article 59, Paragraph 4 of the Public Official Election Act, it is stipulated that loudspeakers cannot be used for election campaigning except during the election campaign period, and Representative Lee repeatedly used a microphone to announce the contents of the press conference at the campaign rally so that the audience could hear.
