민주당 성북을 당무위원회 절차 삭제 이재명 ‘지명’ 위반   

  

민주당 성북을 후보 지명에서 당헌이 규정한 당무위원회 절차를 삭제하고 ‘위임’으로 대체해 이재명 대표가 ‘지명권 행사’로 절차 위반을 보인다.

민주당 당헌은 ‘재추천’에 대해 ‘당무위원회 ‘무효화 조치’에 의한 ‘후보자 선정’ 절차를 104조에 명백히 밝혔다.

민주당은 22일 서면으로 "이재명 당 대표는 위임받은 당무위원회와 최고위원회의 권한으로 서울 강북을 후보로 한민수 대변인을 의결 및 인준했다"고 송파구민을 성북구에 직권 발표했다.

민주당 당헌은 ‘당무위원회’ 23조 ‘권한’에 대해 <15. 공직선거 후보자의 인준>며 <18. ②당무위원회는 권한을 구체적으로 명시하여 당대표 또는 최고위원회에 위임할 수 있다>고 명시해 ‘월 1회 소집’과 ‘최고위원회 필요시 의장이 소집’을 강제했다.

이 대표는 이날 ‘소집 요구권’에서 ‘의장 소집’ 절차를 위반하고 ‘구체적 권한 위임 명시’를 차단하고 ‘위임에 의한 후보자 선정’을 강행했다.민주당 당헌은 28조에서 <당대표는 당헌·당규에 따라 확정된 공직선거 후보자를 추천한다>로 ‘확정 후보 추천권’만 행사하게 명시했다.반면 대표보다 상위에 둔 ‘당무위원회’에 대해 당헌 제24조(소집 등)는 <①당무위원회는 월 1회 소집을 원칙으로 하고, 의장 또는 최고위원회가 필요하다고 인정하거나 재적위원 3분의 1 이상의 요구가 있을 때 의장이 소집한다>, <③상임고문 및 고문은 당무위원회에 출석하여 발언할 수 있다>고 정당의 최고 기구로서 ‘공의제도’를 강제했다.

민주당 당헌은 ‘공직선거 재추천’에 대해 <제104조(재추천) ①공직선거 후보자로 확정된 자의 입후보등록이 불가능하거나, 당규로 정한 사유가 발생하는 때에는 당규로 정한 절차에 따라 추천을 무효로 하고 재추천할 수 있다.>와 <②후보등록기간 촉박 등의 상당한 사유가 있는 때에는 당무위원회에서 추천을 무효화 하고 후보자를 선정하여 재추천할 수 있다>고 규정해 당무위원회 ‘무효화 조치’에 의한 ‘후보자 선정’ 절차를 명시했다.

민주당 당규는 ‘전략 공천’에 대해 <제13조(선정심사)>에서  당헌에 따라서 28조에서 ‘선정 심사 기준’으로 <3. 불출마 및 사고위원회 판정 등으로 해당 선거구에 당해 국회의원 또는 지역위원장이 공석이 된 선거구>로 명시해 현재 지역구에 국회의원이 있는 성북을에 대해 ‘전략대상’ 전환이 불가능하게 규정했고, 이 대표는 이 조항을 ‘차점자가 낙선자이다’는 개인 견해를 적용해 ‘전략 지역’으로 전환했다.

이 대표가 공천 탈당자 대응으로 "규칙은 이미 정해져있다. 정해진 규칙 속에서 경쟁을 하다가 이 규칙이 나에게 불리하다고 하는 것은 자유지만 경기 운영에 문제가 있는 것처럼 말을 하는 것은 옳지 않다"며  "경기하다가 질 것 같으니 경기 안 하겠다, 이런 건 별로 국민들이 보기에 아름답지 않을 것"이라고 지난달 28일 말했다.

안규백 전략공천위원장은 22일 아침  CBS라디오를 통해 “차점자 승계는 거의 없다. 일반적인 총선 과정에서 차점자가 승리한 경우는 거의 드물다”며 “그 전반적인 내용 자체가 후보에 대한 흠결과 하자로 인해 발생한 요인이기 때문에 제3의 인물로 가는 것이 원칙”이라고 ‘당무위원회 배제’를 언론홍보로 발표했다.
