이재명 민주당 대표가 공천탈락 현역 의원들에게 ‘탈당 자유’ 권유한 반면, 우원식 선출 반대 당원의 탈당에 ‘권한 2배’로 사죄하며 파시즘 정당체제를 보였다.
이 대표는 19일 대전에서 "당원 동지 여러분, 최근 당에 대해 섭섭하고 아픈 그런 사연도 꽤 있죠. 혼내주기 위해 '탈당해야지' 생각하시는 분 계시면 당비를 끊으세요. 탈당하면 다시 들어오기 너무 힘들어요"라고 ‘자파 지지자 당원 당비 무료 혜택’을 밝혔다.
같은 자리에서 정청래 최고위원은 "어제 지역구로 한 분이 전화했다. '화가 나서 탈당 신청했는데, 저 그냥 당에 계속 있겠다', 당에서는 그것을 준비해서 여러분들 마음이 풀리실 때까지 기다리기로 했다"고 말했고, 앞서 ‘당원이 주인이다’며 ‘당원 주권주의’ 이념으로 밝혔다.이 대표는 앞서 "당원도 2배로 늘리고 당원의 권한도 2배로 늘리고 당원 중심의 정당을 통해서 국민이 주인인 나라 함께 만들어 가자"고 말했다.
이 대표는 18일 호남에서 "2년 뒤 전국 시도당위원장 선거에서 권리당원 투표 비중을 높이자"고 ‘권리당원 정당 체제 구축’을 밝혔다.
이 대표의 ‘당원 주권주의’는 헌법 1조 ‘국민 주권주의’에 대한 파기로 보인다.
김민석 의원(민주당 상황실장)은 12일 "'추미애 의장'이 순리"라며 "당원주권 존중을 순리로 보는 새 정치문법과 다선의 연장자 우선을 순리로 보던 전통 정치문법이 공교롭게 '같은 해법'을 향하고 있다. 두 문법을 합치시켜 당의 단결과 힘을 키워가는 지혜와 결단이 요구된다"고 당원 주권주의로 ‘국회의장 추미애’를 공표하고 16일 투표로 우원식 의원을 선출했다.
이 대표는 공천 파동의 첫 기자회견에서는 공천 심사 불공정 시비로 탈당자가 속출에 대해 헬스장에서 나오면서 "경기하다가 질 것 같으니 경기 안 하겠다“면서 "최근에 탈당하시는 분들이 한두 분 계신 것 같은데, 입당도 자유고 탈당도 자유"라고 28일 밝혔다.
정당법에서 ‘입당’은 <시ㆍ도당 또는 그 창당준비위원회에 입당신청을 하여 입당원서를 접수한 때에는 당원자격 심사기관의 심의를 거쳐 입당허가 여부를 결정하여 당원명부에 등재>라고 규정해 절차 강제조치에 해당된다.
정당법에서 ‘탈당’은 ‘입당’과 같이 ‘시‧도당에 탈당계’ 제출 절차를 통해 ‘정당의 뿌리인 시‧도당 우선 존중’이고 이 대표는 민주당 중앙당의 대표이면서 이를 고의적으로 파기했다.
정당법은 ‘정당’을 <공직선거의 후보자를 추천 또는 지지함으로써 국민의 정치적 의사형성에 참여함을 목적으로 하는 국민의 자발적 조직을 말한다>고 규정해, ‘후보 추천’을 ‘국민의 의사형성 참여’로 제한해 대표자의 임의적인 ‘추천권 행사’를 금지했다.
정당법은 <제29조(정당의 기구) ①정당은 민주적인 내부질서를 유지하기 위하여 당원의 총의를 반영할 수 있는 대의기관 및 집행기관과 소속 국회의원이 있는 경우에는 의원총회를 가져야 한다>고 규정해 ‘후보 추천’에 ‘당원 총의’로 의원총회 권한을 강제했다.
민주당은 헌법 8조에 의거해 국고지원금을 의석수 기반에 막대한 금액을 지원 받아 수천만원 규모의 당원의 당비보다 수천배 이상 엄청난 규모의 국고 지원 의원 단체이다.
민주당은 국고의존 정당체제에서 국민이 선출한 의원을 비하해 당원 주권주의로 '당원 상위 의원 하위'로 운영하므로서 헌법 8조의 ‘조직 활동 민주적’이고 ‘국민 정치의사 형성 참여 보장’에 위배되면 헌법재판소에 해산 심판 청구에 해당된다.
정당법은 ‘민주적 내부질서 유지’를 <29조(정당의 기구) ①정당은 민주적인 내부질서를 유지하기 위하여 당원의 총의를 반영할 수 있는 대의기관 및 집행기관과 소속 국회의원이 있는 경우에는 의원총회를 가져야 한다>고 강제 규정했다.
정청래 최고위원은 "80%가 넘는 당원과 지지자들의 당심과 민심이 여의도에서 반영됐는가 아니었는가가 문제의 핵심"이라며 "당원과 지지자들은 윤석열 정권과 맞짱 뜨는 통쾌감을 추미애를 통해 보고싶었던 것"이라고 "국회의원 중심의 원내정당에서 당원과 지지자 중심의 대중정당으로 틀을 바꿔야 한다"고 ‘정당 민주주의 파기’를 최고위원회에서 20일 밝혔다.
이 대표가 이날 ‘당비 내지 말라’는 지시는 정당법 <31조(당비)>의 ‘정당의 재정자립’과 ‘같은 정당의 타인의 당비를 부담자 당원 자격 정지’ ‘당비납부의무 불이행 당원에 대한 권리행사의 제한 당원자격의 정지 등에 관해 당헌으로 정한다’ 조항을 위배한 것으로 보인다.
양문석 당선인은 “일반시민 50％ 권리당원 50％로 뽑힌 국회의원 후보가 총선 통과했다. 그렇다면 원내대표 뽑을 때도 국회의장 후보를 뽑을 때도 똑같이 국회의원 50% 당원 50% 비율 적용하면 되지 않나”라고 ‘당원이 의장 선출’을 21일 말했다.이 대표는 국회 앞의 이 자리에서 “왜 의장 선거에서 민심 혹은 당원의 일반적인 의견과 다른 결론이 났는지, 그리고 이걸 어떻게 개선할 건지 두 가지 질문이 있다”고 우원식 의장 선출에 반대 의견을 밝혔다.
이 대표는 국회의장에 의원 선출에 앞서 당원 동원체제에서 ‘추미애 친위 쿠데타 체제’ 만들기로 선출 시도에서 실패하고 정 의원은 이날 ‘정당 엘리트주의 파괴’로 자파로 구축한 의원 체제에 대해 ‘당원 지배 레짐’ 재시도 실패에 의장 선거에 동원한 친위 당원에 사죄를 보인다.
