정부 코로나치료제 ‘공익’에 셀트리온 주식만 폭등

질병청이 코로나 치료제에 ‘공익’으로 발표했던 4월에 비해 공동사업자인 셀트리온은 주식이 4배 급등하며 주주와 서정진 회장이 독점하는 유통전담의 자회사들이 재고를 매출로 잡는 분식회계까지 동원해 최대 이익을 챙겼다.

질병관리본부 국립보건연구원은 4월 13일 셀트리온과 협력연구를 통해 '코로나19' 바이러스에 중화능을 갖는 항체치료제 후보군 38종을 확보했고 확진자 혈액으로 항체치료제 개발하는 과정 중 확보된 것이라고 밝혔다.

발표 당시 김성순 국립보건연구원 감염병연구센터장은 "이번 결과는 정부와 민간의 기술, 자원을 최대한 활용한 협업효과"라며 "코로나19 확진자 치료를 위한 공익적 가치를 민관이 함께 달성한다는 취지로 조기 치료제 개발을 위해 적극적으로 협력해 나가겠다"고 말해, 셀트리온과의 공동사업에 의한 치료제는 ‘공익’이라 밝혔다.

셀트리온은 자회사인 해외유통의 셀트리온헬스케어와 국내유통 셀트리온제약을 별도 회사로 두고 셀트리온의 재고가 매출로 계산되는 분식회계 방식으로 매출 부풀리기를 해왔으나 정부 지원금이 수천억원대가 집중되고 공익사업으로 포장되며 금융과 증권 감독당국의 감독에서 벗어났다.

정은경 질병관리청장은 문재인 대통령 주재 청와대회의에서 “개인 휴대전화 번호만 제공하면 증상, 역학적 연관성을 불문하고 누구나 익명으로 검사를 받을 수 있도록 해 낙인효과를 우려한 검사 기피를 예방할 것”이라 9일 말했다고 청와대가 밝혔다.

정 청창은 “수도권의 잠재된 감염원 차단을 위해 젊은층이 모이는 대학가, 서울역 등 150여개 지역에 임시선별진료소를 설치해 집중 검사기간을 3주간 운영하겠다”고 확진자 휴대전화추적 방역에서 역학조사권에 의한 휴대전화 추적권이 방역법과 무관한 무작위 확대 전략에 의해 질병청장이 ‘무료검진’으로 포장했다.

방역법에 거짓진술 징역2년 처벌조항에 의거하며 확진자에 방역법에 없는 ‘휴대전화 강제추적’에 대해 정부 예산에 의한 검진자 상대 무료검진 대가로 ‘휴대전화 추적동의’를 청와대에서 방역정책으로 결정하는 방식은 방역법을 넘어 선 것으로 보인다.

서정진 셀트리온 회장은 앞서 전국민 코로나진단검사를 요청하고 무증상에서 확진자를 찾아 자사 치료제를 사용할 것으로 밝혔고, 앞서 3월 13일 셀트리온은 코로나 진단키트 개발에 대해 “4월 중 시제품 개발, 5월 말까지 임상시험 완료로 유럽 수출용 인증 신청”을 발표했다.

코로나 초기 14만원대였던 셀트리온 주가는 대유행의 3월에 급등하기 시작해 40만원에 접근했고, 삼성바이오로직스는 30만원에서 80만원대로 급등했다.

정부 협력업체로 코로나 초기 지정된 셀트리온은 해외유통 셀트리온헬스케어와 국내유통 헬스케어제약 3자간에 일감몰아주기와 재고를 매출로 잡는 분식회계로 매출을 확대해 주식이 상승했고, 정부의 국고투입에 이어 질본과 중대본 브리핑에 끼워 넣는 방역 시스템으로 증시에 직접 반영했다.

서정진 회장은 ‘전 국민 진단검사 조기판정후 치료제 조기투여’를 위한 국회 약사법 개정을 '글로벌바이오포럼' 기조발표에서 지난달 25일 공식화했다.

서 회장은 앞서 지난달 20일 한겨레신문과 단독으로 만나 치료제2상 종료(12월21일)을 언급하며 “치료제를 돈벌이 수단으로 삼는 것은 좋지 않다. 국내는 원가(개발비 포함) 수준에서 싸게 공급하고, 해외에는 경쟁 업체보다 저렴한 가격에 공급할 계획이다”면서 “내년 초에는 치료제를 시장에 선보일 수 있을 것이다. 치료제 생산을 이미 시작했기 때문에 식약처 승인을 받으면 바로 나올 수 있다. 치료제가 나오면 국민이 코로나에 대한 불안감을 내려놓을 수 있을 것이다. 내년 봄에는 한국이 마스크 없이 일상생활을 할 수 있는 ‘코로나 청정국’이 될 것이라는 기대를 갖고 있다”고 말하며 ‘선 치료제, 후 백신’을 밝혔다.

서 회장은 일감 몰아주기 증여세로 낸 132억원 가량을 되돌려달라고 낸 소송에서 패소했고,인천지법 행정1부 판결은 셀트리온 매출액 중 셀트리온 헬스케어에 판매해 얻은 매출이 각각 94.57%(2012년), 98.65%(2013년)이고 “서 회장은 셀트리온과 셀트리온헬스케어의 지배주주가 맞다”며 서 회장 측의 모든 주장을 지난해 1월 기각했다.

경제개혁연구소가 지난해 3월 사익편취 회사를 통한 지배주주 일가의 부의 증식 보고서’에서 “서 회장은 셀트리온헬스케어를 통해 자산 4조5395억4300만원을 늘려 대기업 지배주주 3위”라고 밝혔고, 법원은 헬스케어의 서 회장 지분(50.31%) 직접 보유를 확인했다.
