이재명 국가정보 재난 ‘홍보선전 우선’ 권언유착 중대본 배제 재난법 위반

이재명 대통령이 국가정보 화재로 인한 정보 장애 사태에서 ‘홍보 선전 우선’을 적용해 중대본 발동이 후순위로 배제되면서 권언(勸言)유착에 의한 재난법 위반을 보인다.

김민석 총리는 7일 "대통령이 방송에서 말한대로 한국 문화의 핵심인 K-푸드를 세계에 알리는 데 방송의 요리 프로그램은 큰 역할을 하고 있다"라며 "이번 방송은 아예 '전 세계에 알리고 싶은 K-푸드와 식재료'를 주제로 제작되고 넷플릭스에 공개돼 전 세계인이 함께 볼 수 있어 출연하신 것으로 알고 있다"고 밝혔다.

김 총리는 이어 "한미 무역협상, 정부 전산망 복구 지휘, 추석인사를 동시에 소화하면서 예정된 방송 출연을 통해 K-푸드 세계화의 전도사 역할도 하는 것. 그것이 국정의 매 순간 매 사안에 최선을 다해야 하는 대통령의 일"이라고 이 대통령에게 ‘K 푸드 전도사’라고 첫 호칭했고, JTBC는 ‘15분 요리 속도 경연’의 오락프로라고 밝혔다.

이 대통령은 지난달 26일 화재 발생과 귀국 상황에서 27일 국무총리 중대본을 개최하고 28일에 홍보 촬영 일정을 우선해 촬영 이후 오후 5시 중대본을 개최했고 이는 ‘중대본 비상 사태 발동’에서 ‘대통령이 예외’를 적용해 재난법에 대한 위반 사태가 발생했다.

중대본은 재난법에 의거해 국무총리가 27일 발족했고, 이후 28일 오후 5시 이 대통령의 중대본 회의 이전까지 이 대통령은 재난법으로 발동한 국가 재난 사태에서 개인의 예능 홍보 촬영을 우선한 것으로 비상사태에 대한 국가재난법에 대한 직무 유기에 해당된다.

재난법에 의한 중대본은 27일 오전 발족이후 28일 오후 5시 까지 이 대통령의 ‘지시’에 의해 중대본이 중단된 것으로 볼 수 있다.

대통령실은 4일 대변인 성명으로 “27일 국무총리 주재로 중대본 회의가 개최됐고, 당일 오후 6시에 화재는 완진됐다”고 ‘화재 상황’에 국한시켜 ‘사태 종료’로 밝히고 ‘행정 정보 파괴 사태’를 후순위로 밀어냈다.

대변인 성명은 이어 “이 대통령은 28일 오전 10시 50분 비상대책회의를 개최해 대통령실 3실장, 위기관리센터장, 국정상황실장, 대변인 등에게 상황을 보고받고 대책을 논의했다”며 “이 회의에서 28일 오후 중대본 회의 개최 및 부처별 점검 상황을 지시했다”고 밝혔다.

이는 대통령이 28일 국가재난 사태에 대통령의 측근 참모들로 국한시킨 ‘회의’로 패쇄 조치했고, 재난 사고에서 행정부를 접근에서 차단 분리하면서 재난법의 중대본을 완전히 무시했음을 시인한 것이 된다.

행정부 전산망이 마비 상태에 대한 중대본 주도 상황에서 ‘대통령실 측근 국한 회의’는 ‘중대본 기피’에 해당된다.

특히 ‘측근의 비밀 회의’에서 ‘예능 녹화후 오후 5시 중대본으로 확정’을 발표해, 재난법의 중대본을 개인 일정에서 밀어냈고, 이는 중대한 대통령 직무유기로 보인다.

대통령실 대변인은 이어 “이후 오후에 JTBC 프로그램 ‘냉장고를 부탁해’를 녹화했고, 다시 복귀해 오후 5시 30분 중대본 회의를 주재했다”고 발표해, 중대본 발동 사태에서 대통령의 ‘중대본 적용 제외’를 공식 확인했다.

이 대통령이 K문화로 ‘한국 음식’ 홍보 출연이었다고 거듭 해명한 상업방송사 연예 프로그램‘냉장고를 부탁해(냉부해)’ 강행 사건은 대통령의 이규연 홍보수석이 대표를 지낸 JTBC 방송사에 대한 대통령이 직접 ‘방송사 홍보 우선’의 권언유착 전략을 보인다.

김 총리가 이날 주재한 중대본의 설립근거인 재난안전법은 ‘국가책무(4조)에서 “피해 신속 대응ㆍ복구 위한 계획 수립ㆍ시행”이 강제됐다.

이 대통령은 앞서 ‘논문 표절’ 논란이 커진 교육장관 후보에 대해 7월 13일 보수 언론인인 정규재 전 한국경제 주필을 만나 "내가 알아서 (그분을) 추천한 것은 아니고 추천받은 것인데, 조금 문제가 있는 것 같아서 딱하다"고 말해, ‘책임 무관’에 대해 공개했고, 이후 ‘자진 사퇴’한 사건에서 이날 만남은 이규연 언론홍보수석이 주도했다.

정 전 주필은 당시 만남에 대해, 자신이 '저 진숙(이진숙 방송통신위원장)은 어떠냐'고 하니 이 대통령이 "아마도 곧 정치적 선택이 있지 않겠느냐"고 언급했다고도 공개했고 ‘자진 사퇴’로 이어졌다.

이 대통령은 취임사에서 직접 민주주의 도입으로 “새 나라를 위한 국민의 명령을 준엄히 받들겠다”며 “언제 어디서나 국민과 소통하며 국민의 주권의지가 일상적으로 국정에 반영되는 진정한 민주공화국을 만들겠다”고 선언했다.

강훈식 홍보수석 임명에 대해 "이 대통령은 모든 국민을 아우르고 섬기는 모두의 대통령이 되겠다는 뜻을 거듭 강조했다. 이번 인사는 이러한 국민통합 의지가 반영된 것"이라며 "새 정부의 개혁의지와 국민소통을 이끌 적임자로 언제나 국민과의 소통을 최우선으로 두고 업무에 임할 것"이라 발표했다.

냉부해의 자체 홍보 문구에는 "톱스타들의 15분간 요리 대결"로 명백하게 명시하고, 대통령이 차후 광고한 'K 컬쳐 한국 음식 해외 홍보'는 어디에도 없다.

Lee Jae-myung's National Disaster Emergency 'Publicity Priority' Excludes CDSC Headquarters, Violating Disaster and Safety Act, Collusion between Power and Media

President Lee Jae-myung's decision to prioritize public relations and propaganda over the central disaster response headquarters in the wake of the national intelligence fire appears to be a violation of the Disaster and Safety Countermeasures Act due to collusion between power and the media.

Prime Minister Kim Min-seok stated on the 7th, "As the President mentioned on air, cooking programs on TV are playing a significant role in promoting K-food, a core part of Korean culture, to the world."

He added, "This broadcast was produced with the theme of 'K-food and ingredients we want to introduce to the world' and released on Netflix, so people around the world can watch it together, which is why I understand you appeared on it."

Prime Minister Kim continued, "While simultaneously juggling Korea-US trade negotiations, directing the restoration of the government's computer network, and delivering Chuseok greetings, you are also serving as an evangelist for the globalization of K-food through your scheduled broadcast appearance. That is the job of a president who must do his best in every moment and every issue of state affairs." He was the first to call President Lee a "K-food evangelist," and JTBC stated that it was an entertainment program titled "15-Minute Cooking Competition."

Following the fire on the 26th and his return to Korea, President Lee convened a meeting of the Central Disaster and Safety Countermeasures Headquarters on the 27th.

He then prioritized a promotional filming schedule on the 28th, convening a meeting at 5 p.m. afterward. This violation of the Disaster and Safety Countermeasures Headquarters constituted a "presidential exception" to the "declaration of a state of emergency by the Central Disaster and Safety Countermeasures Headquarters."

The Central Disaster and Safety Countermeasures Headquarters was launched by the Prime Minister on the 27th pursuant to the Disaster and Safety Act. Prior to President Lee's meeting at 5 p.m. on the 28th, President Lee prioritized personal entertainment promotional filming during the national disaster declared under the Disaster and Safety Act. This constitutes dereliction of duty under the National Disaster and Safety Act.

The Central Disaster and Safety Countermeasures Headquarters, established under the Disaster and Safety Countermeasures Act, was suspended by President Lee's "direction" from its launch on the morning of the 27th until 5:00 PM on the 28th.

On the 4th, the Office of the President issued a spokesperson's statement, stating, "A Central Disaster and Safety Countermeasures Headquarters meeting was held on the 27th, presided over by the Prime Minister, and by 6:00 PM that day, the fire was completely extinguished." This statement limited the fire situation to the "fire situation" and relegated the "administrative information destruction incident" to a lower priority.

The spokesperson's statement continued, "President Lee convened an emergency response meeting at 10:50 AM on the 28th. He received reports from the three chiefs of staff of the Presidential Office, the director of the Crisis Management Center, the director of the National Situation Room, and the spokesperson, and discussed countermeasures. At this meeting, he ordered a Central Disaster and Safety Countermeasures Headquarters meeting on the afternoon of the 28th and conducted a review of the situation by each ministry."

This constitutes an admission that the President, by limiting the national disaster situation on the 28th to a "meeting" limited to his closest aides, completely disregarded the Central Disaster and Safety Countermeasures Headquarters (CDSCH) provisions of the Disaster and Safety Countermeasures Headquarters (DSCH) by isolating the executive branch from access to the disaster.

In a situation where the CDSCH was leading the response to the paralysis of the executive branch's computer network, a "meeting limited to the President's close aides" constitutes "avoidance of the CDSCH."

Notably, during the "secret meeting of close aides," he announced that "the CDSCH would be held at 5 p.m. after the entertainment program recording," pushing the CDSCH meeting of the Disaster and Safety Countermeasures Headquarters (DSCH) out of his personal schedule, a move that appears to be a serious dereliction of duty on the part of the President.

The presidential spokesperson then announced, "He then recorded the JTBC program 'Please Take Care of My Refrigerator' in the afternoon and then returned to preside over the CDSCH meeting at 5:30 p.m." This officially confirmed the President's "exemption from the CDSCH's application" during the CDSCH activation.

The incident of the president forcing the appearance of the commercial broadcasting entertainment program “Please Take Care of My Refrigerator,” which he repeatedly explained was to promote “Korean food” as part of K-culture, shows the “collusion between power and the media” in which the president directly “prioritized the promotion of the broadcasting company” for JTBC, the representative of which was Lee Kyu-yeon, the president’s senior secretary for public relations.

The Disaster and Safety Countermeasures Headquarters, the basis for the establishment of the Central Disaster and Safety Countermeasures Headquarters presided over by Prime Minister Kim, mandates "the establishment and implementation of plans for rapid response and recovery from damage" under Article 4 of the "National Responsibilities."

President Lee previously met with conservative journalist and former Korea Economic Daily editor-in-chief Jeong Gyu-jae on July 13th regarding the Minister of Education nominee, who had been embroiled in a plagiarism controversy, and stated, "I did not recommend him on my own; I was recommended to him. I feel bad because he seems to have some issues." This led to Lee's subsequent resignation.

The meeting that day was spearheaded by Senior Secretary to the President for Public Relations Lee Kyu-yeon. Former Chief Editor Jeong also revealed that when he asked, "What do you think of Jin-sook (Korea Communications Commission Chairperson Lee Jin-sook)?", President Lee replied, "Perhaps a political choice will be made soon," leading to his "voluntary resignation."

In his inaugural address, President Lee declared that by introducing direct democracy, he would "strictly uphold the people's mandate for a new nation" and "communicate with the people anytime, anywhere, and create a true democratic republic where the people's sovereign will is routinely reflected in state affairs."

Regarding the appointment of Kang Hoon-sik, the President repeatedly emphasized his commitment to becoming a president for all, embracing and serving all citizens. This appointment reflects this commitment to national unity. He announced, "As the right person to lead the new administration's reform efforts and public communication, he will always prioritize communication with the public in his work."

The self-promotional copy of 'Naengbuhae' clearly states that it is a "15-minute cooking competition between top stars," and nowhere is there any mention of 'promotion of K-culture and Korean food overseas,' which the president later advertised.
