한 후보는 대학 재학중 고시 합격에 현직 검사로 미국 컬럼비아대 로스쿨 LL.M. 졸업으로 뉴욕주 변호사이며 미국 출입에 대한 기록은 공개되지 않은 상태다.

유무죄 판단의 배심원에서 수사권자인 체포자 신문자는 재판정의 사건 증인이 되며, 한 후보자가 ‘나쁜 놈’ 판단으로 수사한 검찰은 증인 심문에서 기소 될 수 있다.
