피할 수 없는 승부를 앞두고 있다면
나는 변호사로서 어떠한 사안이든 의뢰인에게 분쟁을 적극적으로 격화시키는 것을 권하지는 않는 편이다. 서로에 대한 공격적 기제가 강해질 수록 분쟁당사자간에 더 큰 상처를 남기게 될 것인바, 개별 분쟁에서 결과적으로 우월적 지위를 얻었다 하더라도 내가 과연 그 분쟁에서 승리했다고 평가할 수 있는지 여부가 불명한 경우가 많기 때문이다.
이러한 논리구조는 분쟁당사자의 머릿속에서도 동일하게 흘러가는 경우가 많기에, 분쟁이 격화되는 기로에 놓인 당사자들은 그 경계선 상에서 어떠한 스탠스를 취해야 할 지 혼란스러워 하는 경우가 많은 것으로 보인다. 이러한 상황에 놓인 분쟁당사자에게 드리고 싶은 말씀은, 어떠한 방법을 선택하던지 당신이 선택한 결과에는 나름의 근거가 있었으며, 다만 문제되는 것은 그 선택이 옳았다는 점에 대하여 믿음을 갖고 있는지 여부에 국한된다는 점이다. 믿음이 부족한 선택은 이를 유지하기 어렵기에 필연적으로 '후회'를 가져오게 될 것인바, 과거를 돌이킬 수 없는 '후회'는 정신과 육체를 갉아먹을 뿐 그 선택의 결과를 변화시킬 수도 없다 할 것인 이상, 선택의 기로에 선 당사자는 신중하되, 일단 선택하였다면 그 선택에 믿음을 가지는 것이 합리적이다.
만일 당신이 의도하였던 그렇지 않았던 분쟁의 한 가운에 서게 되었고, 그 분쟁 속에 뛰어든 것이 당신의 선택에 의한 것이었다면, 심장을 불태우는 마음으로 그 분쟁에서 당신의 권리를 쟁취하기를 바란다. 그럼에도 불구하고 가을 나절의 갈대처럼 마음이 흔들린다면 이 노래를 들으며 의지를 다져볼 것을 권한다.
모름지기 싸움은 피하는 것이 상책이되, 일단 싸움에 휘말렸다면 승리하는 것이 차선책이기 때문이다.
