미국의 시위와 싱가포르의 락다운
What is society?
조지 플로이드의 죽음을 기점으로 #BlackLivesMatter 시위가 전세계로 퍼져나가고 팬데믹이 지속되고 있는 역사적인 시점에서, 싱가포르는 거짓말처럼 조용하다.

국가의 법이 ‘엄격’한 싱가포르에 살고 있는 나는 락다운의 상황에서 이 나라가 국민 혹은 외국인에게 행사하는 공권력들에 대해 들을 때마다 뜨악했다. (참고로 싱가포르는 ‘락다운’이라는 표현은 절대 쓰지 않는다. ‘서킷 브레이커 circuit breaker’라는 표현을 쓴다)

락다운의 상황에서 국가는 어디까지 공권력을 행사할 수 있는가. 싱가포르는 현재 ‘다른 집’에 살고있는 사람을 만나면 안된다는 룰을 적용하고 있다. 다른 집에 살고 있는 남자친구를 만나다가 걸린 (다른 사람들이 리포트함) 로컬 여자분은 만불 (약 800만원) 혹은 6개월 징역을 살아야한다고.
싱가포리안 로컬들은 국가가 정한 룰을 어기는 사람을 볼 시 ‘사진을 찍어서 국가에 리포트’를 하고, 그 리포트를 받은 국가는 법을 강행한다. 서로를 국가에 보고하고 법집행을 받게하는 사람들의 행동이 매번 놀랍다.
한국은 물론 ‘락다운’을 시킨 적이 없지만, 예를 들어 ‘마스크 착용’의 경우 사회적인 분위기, 서로의 눈치를 보며 룰을 따라야 한다면, 싱가포르는 강력한 국가의 룰, 그리고 이것을 어긴 것을 누군가가 ‘리포트’할까봐 따라야 하는, 어찌보면 다소 수동적인 행태를 보인다. 또한 ‘법에 걸리거나, 누군가가 나를 리포트하기 전까지는’ 하고싶은 대로 하는 모습도 보인다. (물론, 모두가 그런건 아니다. 대다수의 싱가포리안들은 국가가 정한 룰을 아주 잘 따르고 있다)
언론이 정부로부터의 독립 조직이 아니기 때문에, (저 위 링크의 mothership도 독립적인 조직이라고는 나오지만, 이 조직도 국가의 컨트롤을 받고 있다는 것을 짐작 할 수 밖에 없다) 한국, 혹은 다른 민주주의 국가였으면 나왔을 비판들, 디스커션들을 찾기 어렵다. 그런 디스커션들이 있다할지라도 시민들의 의견이 ‘공론화될 장’이 없다. 따라서 정부는 ‘일방적으로’ 뉴스 자료들을 시민들에게 내보내고, 시민들은 수동적으로 그것을 ‘따르거나’ 혹은 ‘따르지 않다가 다른 시민이 그걸 정부에 보고해서 걸리거나’ 하는 이 두가지 행동만 가능하다. 이런 룰들을 잘 지키는지 ‘경찰이 돌면서 감시한다, 집을 하나씩 방문하면서 신분증을 확인한다’는 소문이나 루머가 왓츠앱을 통해서 돌기도 하고, 그래서 ‘누군가 잡혀서 벌금내고 비자 취소되었다 (외국인의 경우)’는 소문이 돌기도 한다. 그래서 실제로 감시하는 경찰이 많지 않을 지언정, 이 룰 집행이 실제로 강행된다는 ‘소문’과, 몇몇 눈에 띄는 케이스들 - “언론”에 나오는 위와 같은 케이스들에 강력한 법을 때리는 것을 ‘보여줌’으로써, 시민들은 그저 법을 따를 수 밖에 없다. 타인들을 정부에 ‘걸리라’고 ‘리포트’하는 심리는 사실 나로선 이해가 잘 안가는 부분이다.

아무리 확진자 수가 많아져도 시민의 ‘자유’를 위해, 시민들의 반발이 예상되니 ‘락다운’을 하지 않는 미국, ‘락다운’을 했다가 경제적 여파와 시민들의 반발을 고려해 해지하는 유럽 국가들, 그리고 미국, 유럽 국가들보다 확진자 수도, 사망자 비율도 훨씬 적은데 여전히 락다운을 하고 있는 싱가포르, 그리고 락다운을 한 적이 없는데 contact tracing과 마스크 쓰기 등으로 확진자 수를 초반에 막아낸 한국 (요즘에 다시 늘고 있지만)을 보면서 ‘어디까지 국가는 공권력을 행사할 수 있는가’에 대한 질문이 생긴다. 유발 하라리가 말한 것처럼, 코로나는 정치적 위기라는 말이 실감이 된다.

미국이란 나라에 살아보진 않았지만, 실리콘벨리의 테크 버블에 관심이 있는 사람으로서, 미국에 가족과 지인들을 두고 있는 나로서, 미국의 뉴스와 움직임은 나에게 이전보다 더 큰 영향을 끼친다. 새삼 조지 플로이드 관련한 인종차별 시위가 격해지고 있는 현 상황을 보며 새삼 지금까지 미국 기업들의 사람들과 면접을 진행할 때 모두가 백인 혹은 아시안계 미국인이었다는 것을 깨달았다.
남아프리카 출신의 미국인 코미디언 Travor Noah는 아래 영상에서 이같은 질문을 던진다.
조지 플로이드를 포함한 인종차별 사건들에 분노한 미국 사람들이 슈퍼마켓을 털고, 경찰차를 불태우고, 언론사에 불을 지르는 현 상황에 대해서 말한다.
사회와 시민은 계약관계이고, 그 사회가 그 계약을 따르지 않았을 때, 국가의 법 집행이 법을 따르지 않았을 때, 왜 사회의 시민들은 법을 따라야하는가?
Society, what is society?
Fundamentally when you boil it down, society is a contract.
It’s a contract that we sign as human beings amongst each other.
We sign a contract with each other as people whether it’s spoken or unspoken and we say,
“Amongst this group of us, we agree in common rules, common ideals and common practices that are going to define us as a group. That’s what I think a society is, it’s a contract. And as with most contracts, the contract is only as strong as the people who are abiding by it.
But if you think of being a black person in America, who is living in Minneapolis or Minnesota or any place where you’re not having a good time, ask yourself this question when you watch those people: “What vested interest do they have in maintaining the contract?”
Why don’t we all loot? Why doesn’t everybody, because we’ve agreed on things. There are so many people who are starving out there, who don’t have, who are destitute. There are people who, when the virus hit, and they don’t have a second paycheck, are already broke, which is insane, but that’s the reality.
But, still think about how many people who don’t have, the have-nots.
Say “You know what? I’m still gonna play by the rules even though I have nothing because I still wish for the society to work and exist”
And then, some members of that society, namely black American people watch time and time again,
how the contract that they have signed with society is not being honored by the society that has forced them to sign it with them.

When you see George Floyd on the ground and you see a man losing this life in a way that no person should ever have to lose their life
at the hands of someone who is supposed to enforce the law, what part of the contract is that?
And a lot of people say, well, what good does this do?
Yeah, but what good doesn’t it do? That’s the question people don’t ask the other way around.
What good does it do to loot Target? What does it, how does it help you to loot Target?
Yeah, but how does it help you to not loot Target? Answer that question. Because the only reason you didn’t look Target before was because you were upholding society’s contract. There is no contract if law and people in power don’t uphold their end of it.
And that’s the think I think people don’t understand sometimes is that we need people at the top to be the most accountable because they are the ones who are basically setting the tone and the tenor for everything that we do in society.

And so, if the example law enforcement is setting is that they do not adhere to the laws, then why should the citizens of that society adhere to the laws when in fact, the law enforces themselves don’t?
