이재명 민주당 대표가 후보 탈락자들에게 당헌 당규를 벗어난 ‘시스템 새 후보 추천’과 ‘탈당자유 권유’에서 정당법의 ‘후보추천 국민 의사형성 참여’와 ‘입당’ ‘탈당’에 대한 ‘시‧도당 승인 절차’를 위반했다.

더불어민주당 당헌 당규는 어디에도 ‘새 사람 추천’ 조항이 없으며, ‘정당 민주주의와 정당 3권 분립’을 강제 규제했다.

이 대표는 지난달 28일 ‘당규’와 ‘시스템’ 분리를 공식 확인했고, 시스템에 의한 ‘당헌 당규 위반’을 보인다. 

이 대표의 ‘새로운 사람 기회 부여’ 공천 기준 권한 행사는 정당법의 후보 추천권 규정인 ‘국민 의사형성 참여’에 위반된다. 

이 대표는 “이번 공천 과정에서 이런저런 소리가 많이 나온다. 그러나 변화해야 새로운 시대를 맞을 수 있다. 새로운 사람들에게도 기회를 줘야 한다”고 지난달 28일 발표했다.

이 대표는 이어 “최근에 탈당하는 분들이 한두 분 계신 것 같은데 입당도 자유고 탈당도 자유다. 그런데 경기를 하다가 질 것 같으니까 경기 안 하겠다는 것은 국민들 보시기에 아름답지 않을 것이다”고 말해 ‘정당법의 입당 절차’ 조항을 위반했다.

정당법의 ‘국민의 정치 의사 형상 참여’는 국민의 정치 의사인 ‘투표’가 기준이고 투표 이전에 정당 대표에 의한 ‘새 사람 추천’ 기준선이 ‘투표에 의한 정치의사 표시 방해’에 해당된다.

정당법은 ‘정당’을 <공직선거의 후보자를 추천 또는 지지함으로써 국민의 정치적 의사형성에 참여함을 목적으로 하는 국민의 자발적 조직을 말한다>고 규정해, ‘후보 추천’을 ‘국민의 의사형성 참여’로 제한해 ‘추천권의 임의적 행사’와 구분했다.

정당법에서 ‘입당’은 <시ㆍ도당 또는 그 창당준비위원회에 입당신청을 하여 입당원서를 접수한 때에는 당원자격 심사기관의 심의를 거쳐 입당허가 여부를 결정하여 당원명부에 등재>라고 규정해 절차 강제조치에 해당된다.

정당법에 의거해 ‘탈당’은 ‘입당’과 같이 ‘시‧도당에 탈당계’ 제출 절차를 통해 ‘정당의 뿌리인 시‧도당 우선 존중’이고 이 대표는 중앙당의 대표로 이를 파기했다.

이 대표는 공천 탈락이 불거진 이날 “시스템이 다 갖춰져 있다. 1년 전에 만들어진 당규가 있고 시스템에 따른 평가가 있고 투명한 심사 결과로 좋은 후보들이 골라지고 있다”고  ‘투명 심사’로 말했으나 당헌 당규가 강제한 ‘표결’ 포함 회의록을 공개하지 않았다.

민주당 당헌은 2조 목적에서 ④ 항으로 <더불어민주당은 정당의 3권 분립과 중앙당과 시·도당의 분권 등을 통해 정당민주주의를 구현한다>고 규정했다. 

당헌 규정은 <제2조(목적) 더불어민주당은 공정하고 평등한 사회, 생명의 가치를 중시하고 안전을 보장하는 사회, 보편적 복지를 추구하는 포용사회, 혁신과 성장을 통해 모든 지역이 골고루 번영하는 나라, 한반도 평화를 넘어 동아시아 및 세계 평화를 추구하는 나라를 지향한다>.

당헌은 전문에서 <우리는 ‘공정, 생명, 포용, 번영, 평화’를 핵심가치로 삼아 ‘내 삶이 행복한 나라’를 만들 것이다. 첫째, 특권과 차별, 불평등 없이 모든 사람이 기회를 갖고 역량을 발휘할 수 있는 공정하고 평등한 사회를 실현한다>로 ‘새 사람 추천’과 완전 충돌한다. kimjc00@hanmail.net

Lee Jae-myeong, leader of the Democratic Party, went from 'recommending a new candidate in a system' and 'encouraging freedom to withdraw from the party' to candidates who were eliminated from the party's constitution, to 'participation in forming the public opinion by recommending a candidate' and 'city/provincial party approval procedures' for 'joining' and 'withdrawing' from the party under the Political Party Act. ' was violated.

The Democratic Party of Korea's constitution does not contain any provisions for 'recommendation of new people', and it forcibly regulates 'party democracy and separation of three political parties'.

Representative Lee officially confirmed the separation of ‘party rules’ and ‘system’ on the 28th of last month, showing ‘violation of party constitution and rules’ by the system.

Representative Lee’s exercise of authority based on nomination criteria to ‘give opportunities to new people’ violates ‘participation in forming the public opinion’, which is a provision of the right to recommend candidates under the Political Parties Act.

Representative Lee said, “During this nomination process, many voices are raised. However, we must change to enter a new era. “We need to give new people a chance,” he announced on the 28th of last month.

Representative Lee continued, “I think there are one or two people who have left the party recently, but they are free to join and leave the party. However, it would not be good in the eyes of the people to not play because it looks like they will lose if they play,” violating the provisions of the ‘Party Membership Procedure under the Political Parties Act.’

The Political Party Act’s ‘participation in shaping the political will of the people’ is based on ‘voting’, which is the political will of the people, and the standard of ‘recommendation of a new person’ by a party representative before voting is equivalent to ‘interfering with the expression of political will through voting’.

The Political Party Act defines 'political party' as <refers to a voluntary organization of the people whose purpose is to participate in the formation of the people's political opinion by recommending or supporting candidates for public elections>, and defines 'candidate recommendation' as 'participation in the formation of the people's opinion.' ' and distinguished it from 'arbitrary exercise of the right to recommend.'

In the Political Party Act, 'joining a party' is defined as <when an application for membership is submitted to a city/provincial party or its party founding preparation committee and an application for membership is received, the party membership qualification review body decides whether to join the party or not and registers it in the party member list>, forcing the procedure. It is subject to action.

According to the Political Party Act, ‘withdrawal from the party’, like ‘joining the party’, is ‘priority respect for the city/provincial party, which is the root of the political party’, through the process of submitting ‘a notice of withdrawal to the city/provincial party’, and Representative Lee, as the representative of the Central Party, destroyed this.

Representative Lee said on the day that the nomination rejection was raised, “The system is all in place. “There is a party rule created a year ago, there is an evaluation according to the system, and good candidates are being selected as a result of a transparent review,” he said, referring to the “transparent review,” but did not disclose the minutes of the meeting, including the “vote” mandated by the party constitution.

The Democratic Party Constitution stipulates in Article 2 Purpose in Clause ④ that <The Democratic Party of Korea implements party democracy through separation of political parties into three powers and decentralization of power between the central party and city/provincial parties.>

The party constitution stipulates that <Article 2 (Purpose) of the Democratic Party is to create a fair and equal society, a society that values the value of life and guarantees safety, an inclusive society that pursues universal welfare, and a society where all regions prosper evenly through innovation and growth. We aim to become a country that pursues peace in East Asia and the world beyond peace on the Korean Peninsula.>

The party constitution states in its preamble, “We will create ‘a country where my life is happy’ with ‘fairness, life, inclusion, prosperity, and peace’ as our core values. First, it completely conflicts with ‘recommending new people’ as it aims to “realize a fair and equal society where everyone has opportunities and can demonstrate their capabilities without privilege, discrimination, or inequality.”
