이재명 대통령 ‘정치가 국민 평화’ 헌법 ‘세계평화 국민 균등향상’ 위배

이재명 대통령은 14일 ‘국민 여러분께 보고’에서 "정치의 가장 중요한 사명은 국민의 안전과 평화를 지키는 것"이라고 발표해, 헌법의 <국민생활 균등 향상>과 <항구적인 세계 평화 기여>에 위배를 보인다.

이 대통령은 이어 전날 대통령실에서 재벌 총수들과 경제단체장들과의 간담회를 소개하면서 "함께 협력해 미국의 통상 압박 등에 대한 대응책을 마련하기로 했다"고 밝혀, 통상 협상에서 헌법이 보장한 ‘국민 정치의사 민주적 형성’과 ‘정치적 자결권 행사’를 배제하고 전문의 ‘국민생활 균등 향상’을 위반하고 정치적 자결권을 방해했다.

헌법은 전문에서 <안으로는 국민생활의 균등한 향상을 기하고 밖으로는 항구적인 세계평화와 인류공영에 이바지함으로써 우리들과 우리들의 자손의 안전과 자유와 행복을 영원히 확보할 것을 다짐하면서>고 명시해 ‘국민의 안전 평화’ 보다는 <우리들과 우리들의 자손의 안전과 자유와 행복을 영원히 확보>가 최고우위이고 이에 대한 ‘대통령의 헌법 수호’를 제 65조에 명시하고 제69조에서 <대통령은 취임에 즈음하여 다음의 선서를 한다>고 강제 조항을 뒀다.

대통령 취임 선서는 헌법 69조에서 <"나는 헌법을 준수하고 국가를 보위하며 조국의 평화적 통일과 국민의 자유와 복리의 증진 및 민족문화의 창달에 노력하여 대통령으로서의 직책을 성실히 수행할 것을 국민 앞에 엄숙히 선서합니다.">로 명시됐다.

헌법은 특히 제5조에서 < ① 대한민국은 국제평화의 유지에 노력하고 침략적 전쟁을 부인한다.>로 명시해 ‘국제평화 유지’가 최고 목표이고 대통령을 이를 준수할 의무가 있고 이를 취임에 앞서 선서했다.

헌법은 8조에서 <② 정당은 그 목적·조직과 활동이 민주적이어야 하며, 국민의 정치적 의사형성에 참여하는데 필요한 조직을 가져야 한다>고 명시했고, 이는 정치에 대해 <민주적 조직 확동>과 <국민의 정치적 의사 형성 참여 조직>을 강제했다.

이 대통령이 국민 보고에서 밝힌 "정치의 가장 중요한 사명은 국민의 안전과 평화를 지키는 것"이라는 규정은 ‘국민의 정치 의사 민주적 형성’을 정면으로 배척하고 헌법이 목표로 제시한 ‘국민생활 균등 향상’과 ‘항구적인 세계 평화 기여’에 위반을 보인다.“ .

이 대통령은 이날 인스타그램에 '이재명의 오늘 국민 여러분께 보고드립니다' 제목으로 "정치의 가장 중요한 사명은 국민의 안전과 평화를 지키는 것"이라며, 이스라엘의 이란 공습 관련 긴급 점검회의를 진행했다며 "우선적으로 우리 교민의 안전을 지킬 수 있도록, 또 외부 충격으로 인해 우리 경제가 큰 피해 입지 않도록 필요한 조치 잘해 나가겠다"고 밝혔다.

이 대통령은 이어 재벌 총수들과 경제단체장들과 만난 자리를 "함께 협력해 미국의 통상 압박 등에 대한 대응책을 마련하기로 했다"고 ‘통상 정책’이 국민의 정치 의사에서 ‘단절’을 보장하고 통상 이해관계자들에 의한 패쇄적 전략을 최고 우위 정책으로 규정해 ‘정치적 자결권 행사’를 차단했다.
