홍콩의 범죄자 인도법 대상 범죄
홍콩 여행 전에 한번씩 읽어 보는 것이 좋겠다
홍콩에서 촛볼 집회가 열렸다. 홍콩에 여행다녀오신 분들이 많을 것으로 생각한다. 그래서 홍콩의 거리 구조 상 백만의 인파가 시위를 한다는 것이 얼마나 생각하기 어려운 일인지도 다들 아실 것으로 빋는다.
이번에 문제가 되고 있는 홍콩 범죄자 인도법은 홍콩 거주자들 뿐만 아니라 홍콩을 경유하는 여행자들도 그 대상이 되며 특히 현실적으로는 중국 정부 입장에 따라 자의적인 해석과 집행이 가능할 것이라는 점에서 많은 사람들의 우려를 사고 있다.
그리고 이제 현실적으로도 홍콩을 여행하거나 홍콩에서 비행기를 갈아 타는 경우에도 만에 하나 있을 수 있는 중국 정부의 범죄자 인도 요청 가능성에 대해 모두들 여행 전에 한번은 짚어봐야 할 때가 된 것 같다. 그리고 어디서도 정작 홍콩 법죄자 인도법의 구체적인 내용을 소개하고 있는 곳이 없어 필자가 해당 범죄 부분만 해석해서 공유하고자 한다. 총 46개항의 대상 범죄를 소개하며 이중 9개의 범죄가 리스트에서 삭제되었다고 한다. 하지만 범죄의 해석을 매우 융통성있게(?) 하는 중국 정부의 속성 상 취소된 부분도 알아 두는 편이 좋다고 보아 역시 해석하였다. 필자는 법률 전문 지식이 없어 번역 내용 중 부정확한 번역이 있을 수 있다. 그래도 여러분들에게 도움이 되면 좋겠다.
범죄자 인도 대상 범죄
1. 사망에 이르게 방치한 것을 포함한 살인 및 과실치사, 살인 미수 등(Murder or manslaughter, including criminal negligence causing death; culpable homicide; assault with intent to commit murder.)
2. 자살 방조, 자살 지원(Aiding, abetting, counselling or procuring suicide.)
3. 고의 상해, 상해, 살해 위협, 무기를 이용한 고의적 또는 무모한 생명 위협, 위법적 상해 관련 위반(Maliciously wounding; maiming; inflicting grievous or actual bodily harm; assault occasioning actual bodily harm; threats to kill; intentional or reckless endangering of life whether by means of a weapon, a dangerous substance or otherwise; offences relating to unlawful wounding or injuring.)
4. 강간을 포함한 성적 공격, 성 폭력, 부도덕 폭행, 아동에 대한 불법적 성적 행위, 법적 성희롱(Offences of a sexual nature including rape; sexual assault; indecent assault; unlawful sexual acts on children; statutory sexual offences.}
5. 아동, 지적 장애인, 무의식인 사람을 대상으로하는 외설(Gross indecency with a child, a mental defective or an unconscious person.)
6. 납치, 유괴, 불법 감금, 불법 구속, 인신매매, 인질(Kidnapping; abduction; false imprisonment; unlawful confinement; dealing or trafficking in slaves or other persons; taking a hostage.) 7. 범죄적 위협(Criminal intimidation.)
8. 마약, 향정신성 약품, 그리고 마약과 향정신성 약품 제조에 필요한 전구 물질 및 필수 화학 물질 등 위험 약품에 관한 법에 대한 위반, 마약 인신매매 절차에 관련된 위반(Offences against the law relating to dangerous drugs including narcotics, psychotropic substances, precursors and essential chemicals used in the illegal manufacture of narcotics and psychotropic substances; offences relating to the proceeds of drug trafficking.)
9.사기, 약취, 절도 등을 통한 금전적 또는 재산상의 이익을 얻는 행위, 불법 침입을 포함한 절도, 도용, 협박, 강요, 재산의 불법적인 거래 또는 수납, 회계 부정, 사기를 포함한 재산 또는 회계 관련된 모든 범법, 불법 재산 박탈에 관련된 모든 위반(Obtaining property or pecuniary advantage by deception; theft; robbery; burglary (including breaking and entering); embezzlement; blackmail; extortion; unlawful handling or receiving of property; false accounting; any other offence in respect of property or fiscal matters involving fraud; any offence against the law relating to unlawful deprivation of property.)

10. 파산법 위반(Offences against bankruptcy law or insolvency law.)
11.기업 간부, 경영진, 발기인들에 의한 범법을 포함한 기업 관련 법 위반(Offences against the law relating to companies including offences committed by officers, directors and promoters.)
12. 증권 및 선물 거래법 위반(Offences relating to securities and futures trading.)
13. 위조 관련 위반, 위조 및 위조 전파법 위반(Offences relating to counterfeiting; offences against the law relating to forgery or uttering what is forged.)
14. 지적재산권, 판권, 특허, 상표 관련법 위반(Offences against the law relating to protection of intellectual property, copyrights, patents or trademarks.)
15. 뇌물공여, 부패, 비밀 수수료, 신뢰 위반 등의 위반(Offences against the law relating to bribery, corruption, secret commissions and breach of trust.)
16.위증 및 위증 수뢰(Perjury and subornation of perjury.)
17. 공무 집행 방해 및 곡해(Offence relating to the perversion or obstruction of the course of justice.)
18. 방화, 컴퓨터 데이터 관련 장난 또는 범죄적 훼손(Arson; criminal damage or mischief including mischief in relation to computer data.)
19. 무기 관련법 위반(Offences against the law relating to firearms.)
20. 포발물 관련 법 위반(Offences against the law relating to explosives.)
21. 공해 및 공중 위생 관련 법 위반(Offences against the law relating to environmental pollution or protection of public health.)
22. 폭동 및 해상 선반 상에 발생하는 모든 폭동성 행위(Mutiny or any mutinous act committed on board a vessel at sea.)
23. 항공기 또는 선박을 포함한 해적 행위(Piracy involving ships or aircraft.)
24. 항공기 및 모든 교통 수단에 대한 불법적 탈취 및 통제 행위(Unlawful seizure or exercise of control of an aircraft or other means of transportation.)
25.학살 또는 학살 선동 행위(Genocide or direct and public incitement to commit genocide.)
26. 체포된 인물의 탈출을 돕거나 방조하는 행위(Facilitating or permitting the escape of a person from custody.)
27. 모든 유형 재화의 수출입 관리에 관한 법률 또는 국제 자금 이체법 위반(Offences against the law relating to the control of exportation or importation of goods of any type, or the international transfer of funds.)
28. 밀수, 유물을 포함한 금수품의 수출입에 관한 법률 위반(Smuggling; offences against the law relating to import and export of prohibited items, including historical and archaeological items.)
29. 불법적인 여권 또는 비자의 획득 및 사용을 포함한 출입국 관리법(Immigration offences including fraudulent acquisition or use of a passport or visa.)
30. 금전적 이익을 위하여 불법 입국을 돕는 행위(Arranging or facilitating for financial gain, the illegal entry of persons into a jurisdiction.)
31. 도박 및 복권 관련 법 위반(Offences relating to gambling or lotteries.)
32. 불법 낙태 행위(Offences relating to the unlawful termination of pregnancy.)
33. 불법 아동 노출, 억류, 유기, 유괴, 그리고 아동 착취를 포함한 기타 위반(Stealing, abandoning, exposing or unlawfully detaining a child; any other offences involving the exploitation of children.)
34. 매춘 및 매춘 목적의 가옥 제공(Offences against the law relating to prostitution and premises kept for the purposes of prostitution.)
35. 불법 컴퓨터 사용(Offences involving the unlawful use of computers.)
36. 세무 관련 회계 규정 위반(Offences relating to fiscal matters, taxes or duties.)
37. 감옥에서의 폭동, 구속 상태에서의 불법 도망 등(Offences relating to unlawful escape from custody; mutiny in prison.)
38.중혼죄(Bigamy.)
39. 여성 관련 위반(Offences relating to women and girls.)
40. 거짓 또는 오도하는 거래 설명에 관련된 범죄(Offences against the law relating to false or misleading trade descriptions.)
41. 본 법에 기술된 모든 위반 사항 관련 커미션을 받은 수입을 소유하거나 세탁하려 하는 행위(Offences relating to the possession or laundering of proceeds obtained from the commission of any offence described in this Schedule)
42. 본 법에 기술된 범법 행위를 저질렀거나 저질렀을 것으로 믿어지는 사람에 대한 체포나 기소를 저해하는 행위(Impeding the arrest or prosecution of a person who has or is believed to have committed an offence described in this Schedule)
.43. 국제 협약 하에 인도된사람들에 대한 위반, 국제 기구의 의사 결정의 결과 발생하게된 위반(Offences for which persons may be surrendered under multi-lateral international conventions; offences created as a result of decisions of international organizations.)
44. 사기 또는 사기 미수 범죄 모의(Conspiracy to commit fraud or to defraud.)
45. 본 법에 기술된 모든 위반에 대하여 단독 또는 연맹하여 위반 또는 위반을 계획하는 행위(Conspiracy to commit, or any type of association to commit, any offence described in this Schedule)
46. 본 법에 기술된 범죄를 의도하거나 주도하거나 종범이 되거나 지원, 사기, 상담, 지도하는 행위(Aiding, abetting, counselling or he commission of, inciting, being an accessory before or after the fact to, or attempting to commit an offence described in this Schedule)
대만의 매체에 따르면 상기 46개 항 중에서 9개 항이 삭제되었다고 한다. 삭제된 항들은 콤패터 사용에 관한 부분과 상업 활동에 관한 부분이라고 한다. 하지만 탈세, 관세 부분 등은 남았다고 하는데 정확한 것은 개정된 원안을 구해야 할 수 있을 것 같다. 현재 제시된 구 버전의 원문을 찾아 보실 분들은 아래 링크를 참조하기 바란다.
