머스크 DOGE 임명없이 백악관 직원으로 연방정부 해고 ‘헌법위반’  

    

머스크가 지휘하는 정부효율성부(DOGE)가 ‘헌법 위반’으로 정부의 공식 직책없이 정부조직과 정부 정보를 장악하고 공무원을 해고했다는 연방 판사의 지적이 나왔다.

콜린 콜라-코텔리 연방 판사는 워싱턴 연방지방법원에서 열린 23일 청문회에서 “미국 국무부 서비스(US DOGE SERVICE)로 알려진 머스크 씨의 조직과 운영에 합헌성에 의문이 있다”며 “이 법안이 연방 기관의 수장(administrator)은 대통령이 지명하고 상원의 인준을 받아야 한다는 헌법의 임명 조항을 위반한 것”으로 우려를 표명했다.

청문회에서 콜라-코텔리 판사는 정부 측 변호사인 브래들리 험프리스(Bradley Humphreys)에게 “이 서비스의 관리자를 밝혀달라”고 거듭 요청했으나 험프리스 변호사는 대답할 수 없었다고 뉴욕타임스가 24일 보도했다.

콜라-코텔리 판사는 이어 정부측 험프리스에게 “머스크가 어떤 직책을 맡고 있는가” 질의했고, 험프리스 변호사는 “머스크가 DOGE 서비스의 관리자도 아니고 그 조직의 직원도 아니다”고 답변했다고 NYT가 밝혔다.

판사는 이어 “머스크의 실제 직업이 무엇이냐”고 질의했고, 험프리스는 "나는 그가 대통령의 측근 보좌관이라는 것 외에 다른 정보를 갖고 있지 않다"고 대답했다.

백악관 대변인 조슈아 피셔(Joshua Fisher)는 17일 저녁 미국 뉴멕시코 지방 판사에 보낸 답변서에서 "머스크는 미국 국무부 행정관이 아니다"라고 분명하게 밝혔다. 

조슈아 피셔 대변인의 이와 같은 답변서는 민주당 법무장관이 머스크와 DOGE가 주도한 대량 해고 사태에 대해 제기한 소송 심리 중인 미국 뉴멕코주 지방판사 타냐 S. 처트칸(Tanya S. Chutkan)에게 보낸 답변서에 명시했다.

피셔 대변인의 뉴맥시코 법원 답변서 3항은 머스크(Mr. Musk)가 "백악관 집무실(White House Office) 직원(employee)"이며 "미국 국무부 직원이 아니다(none-career Specail Government Employee(SGE)"고 명시했다.

대변인 답변서 4항은 “그의 업무(jop)는 대통령 ‘자문관(Seniol Advicer)"로 명시했다.(문서번호, 1:25-cv-00429)

트럼프의 최초 행정명령은 ‘DOGE 행정관 권한'에 대해 “기관장이 DOGE 팀원을 선택”하는 데 도움을 주고, 정부 기술을 업데이트하기 위한 "소프트웨어 현대화 이니셔티브"를 시작하는 권한이 명시됐다.

트럼프의 두 번째 행정명령은 “DOGE 행정관이 각 연방 기관으로부터 매월 고용 보고서를 받고 240일 이내에 명령 이행에 대한 보고서를 트럼프에게 제출할 것”이라 명시했다.

이 행정명령은 ‘대통령에게 제출할 명령 이행 보고서’에 대해 “DOGE 행정관”으로 분명하게 명시했으나 그 보고서의 작성자가 누구인지는 백악관이 거부해 전혀 알려지지 않았다.

연방정부 공무원의 대량해고를 이메일 통고한 ‘DOGE 행정관’은 실체가 없이 명령을 주도하고 이메일로 ‘업무보고’를 지시했으나 이날 정부측의 대응에서 실제  머스크는 “지명”이나 “확정” “인준” 절차가 없었다고 확인했다. 

연방 판사는 특히 이 신생 정부 기구인 ‘정부효율성부(USDS)’에 대해 "내가 가진 제한된 기록에 비추어 볼 때, 나는 USDS의 구조와 운영의 합헌성에 대해 약간의 우려를 가지고 있다"고 밝혔다,

머스크가 주도하는 대량 해고 사업에 대한 콜라-코텔리 판사의 이날 청문회 발언은 두 개의 노동조합과 수백만 명의 미국 퇴직자를 대표하는 그룹이 제기한 민사 소송의 일부로 진행됐다.

해고자들과 노동조합은 머스크 팀이 연방정부 재무부가 관리하는 민감한 공무원 기록과 재무 기록에 접근하는 것을 금지해 달라는 ‘접근 금지 명령’의 민사소송이다.

지난주 맨해튼 연방법원의 한 연방 판사는 이와 비슷한 법적 쟁점 심리에서 “머스크의 정부효율성부가 연방정부 기록에 대한 접근이 불법”이라고 제기한 다른 소송이 끝날 때까지 “재무부의 결제 및 데이터 시스템에 대한 접근을 재개 금지”로 명령했다.

NYT는 “이 소송은 정부 지출을 면밀히 조사하고 연방 인력을 감축하려는 머스크 씨의 광범위한 노력에 도전하는 여러 가지 중 하나”라며 “이로 인해 머스크와 여러 연방 기관 수장들의 결투 지시가 나왔고, 신속하게 해고 통지가 발생했다”고 밝혔다.

콜라-코텔리 판사는 이날 정부측 변호사에게 "만약 당신이 이러한 기능들 중 일부를 수행할 권한이 없는 사람들이 있다면, 그것은 문제를 제기하는 것 같다"며 "지금쯤이면 누가 행정관이고, 누가 행정관 대행이며, 그들이 어떤 권한을 가지고 있는지 알 수 있기를 바란다"고 말했다.

트럼프 대통령이 취임 첫날 행정명령으로 시작된 '정부 효율성부(Department of Government Efficiency)'의 운영자를 정확히 밝혀지 않았다,

트럼프 대통령이 앨론 머스크에 대한 언급은 “비벡 라마스와미(Vivek Ramaswamy)와 함께 "부 효율성부를 이끌 것"이라고 말한 것에 불과했으나, 이후 지난달에 이미 라마스와미(Ramaswamy)가 물러났다고 NYT가 18일 밝혔다.

트럼프 대통령이 취임 첫날 발동한 행정명령에는 ‘절감 기구’ 설립을 명명하면서 ‘보고서 작성자'로 명시한 '행정관'이 누구인지는 전혀 언급되지 않았다. 

행정명령의 조항 중 3(b)는 "대통령 집무실에 설치된 USDS 관리자가 백악관 비서실장에게 보고해야 한다"고 명시했다.

행정명령에서 용어는 연방정부 가구 수준의 부서가 아닌 것으로 공식 명칭을 처음에 United States DOGE Service로 쓰고 약어로 USDS를 사용했다.

기자들은 끈질기게 지난주 백악관 대변인에게 “USDS 행정관의 신원을 밝혀달라"는 거듭 요청했으나 대변인은 이에 응답하지 않았다.

머스크는 앞서 22일 X에 "대통령 지시에 따라 모든 연방 정부 직원들은 곧 지난주의 업무 성과를 보고하라는 이메일을 받게 될 것"이라며 "회신하지 않을 경우 사직으로 간주하겠다"고 인사권 행사를 밝혔다.     

트럼프 체제 신설 정부효율부(DOGE) 직원 21명은 "기술적 전문성을 사용해 중요한 공공 서비스 해체하는 것을 거부한다"며 "우리는 연방 행정부에서 국민을 위해 봉사하고 헌법을 수호하겠다고 맹세했다. 그러나 더 이상 그러한 약속을 지킬 수 없다는 것이 분명해졌다"고 집단사직서를 24일 제출했다.집단사직서에서 그들은 "DOGE 수장(administrator)인 일론 머스크 테슬라 CEO가 임명한 다수가 정부 규모 축소, 규제 철폐, 비용 절감 등을 위해 필요한 기술이나 경험이 없는 정치적 이념가들"이라고 밝혔다고 AP가 보도했다.

Musk DOGE's White House Staff Dismissal as Federal Government Employee 'Unconstitutional'

A federal judge has pointed out that the Department of Government Efficiency (DOGE) led by Musk 'unconstitutionally' seized government organizations and government information without an official government position and dismissed government officials.

At a hearing held in the U.S. District Court in Washington on the 23rd, Federal Judge Colin Cola-Kotelli expressed concerns that "the constitutionality of Mr. Musk's organization and operation, known as the US DOGE SERVICE, is questionable" and that "this bill violates the Appointments Clause of the Constitution, which requires that the head of a federal agency be nominated by the president and confirmed by the Senate."

During the hearing, Judge Cola-Kotelli repeatedly asked the government's lawyer, Bradley Humphreys, to "identify the manager of this service," but Humphreys was unable to answer, the New York Times reported on the 24th.

Judge Cola-Kotelli then asked Humphries, who is on the government side, “What position does Musk hold?” Humphries responded, “Musk is neither a manager of DOGE nor an employee of that organization,” the Times reported.

The judge then asked, “What is Musk’s actual job?” Humphries responded, “I have no information other than that he is a close aide to the president.”

White House Press Secretary Joshua Fisher clearly stated in a written statement to the U.S. District Judge for the District of New Mexico on the evening of the 17th, “Musk is not an administrator of the U.S. Department of State.”

Fisher’s statement was included in a written statement to U.S. District Judge Tanya S. Chutkan, who is hearing a lawsuit filed by Democratic attorneys general over the mass layoffs led by Musk and DOGE. In paragraph 3 of the New Mexico court filing, Spokesperson Fisher stated that Mr. Musk is an “employee of the White House Office” and a “none-career Specail Government Employee (SGE).”

In paragraph 4 of the Spokesperson’s filing, he stated that his job title is “Seniol Advicer” to the President. (Docket No. 1:25-cv-00429)

Trump’s first executive order stated that the “DOGE Administrator Authority” would be to “assist agency heads in selecting DOGE team members” and to initiate a “software modernization initiative” to update government technology.

Trump’s second executive order stated that “the DOGE Administrator will receive monthly employment reports from each federal agency and will submit a report to Trump on the implementation of the order within 240 days.”

The executive order stated that the “report to the President on the implementation of the order” would be “DOGE The report was clearly written by the “Administrator,” but the White House denied the report, leaving it completely unknown who wrote it.

The “DOGE Administrator,” who sent the email notification of the mass layoffs to federal employees, led the order without substance and ordered a “business report” via email, but in the government’s response that day, Musk confirmed that there was no “designation,” “confirmation,” or “approval” process.

The federal judge specifically said of the new government agency, the “Department of Government Efficiency (USDS),” “Based on my limited record, I have some concerns about the constitutionality of the structure and operation of the USDS.”

Judge Kola-Kotelli’s comments at the hearing today regarding the Musk-led mass layoffs were part of a civil lawsuit filed by two labor unions and a group representing millions of American retirees.

The civil suit, filed by the laid-off employees and the unions, seeks a “restraint order” to prevent Musk’s team from accessing sensitive government employee and financial records maintained by the Treasury Department.

Last week in Manhattan A federal judge in a similar legal dispute has ordered the Treasury Department to “reopen access to payment and data systems” until another lawsuit is resolved, alleging that Musk’s Office of Government Efficiency’s access to federal records is unlawful.

The lawsuit is one of several challenging Mr. Musk’s broader efforts to scrutinize government spending and cut federal staffing, the Times reported, adding that it “led to dueling orders from Musk and heads of several federal agencies, and to swift layoff notices.”

“If you have people who are not authorized to perform some of these functions, that seems to be a problem,” Judge Kola-Kotelli told government lawyers that day. “I hope by now you know who is the administrator, who is the acting administrator, and what authority they have.” President Trump did not specify who will run the Department of Government Efficiency, which was launched by executive order on the first day of his inauguration.

President Trump's mention of Elon Musk was limited to saying that he would "lead the Department of Government Efficiency" with Vivek Ramaswamy, but the New York Times reported on the 18th that Ramaswamy had already stepped down last month.

The executive order that President Trump issued on the first day of his inauguration did not mention at all who the "executive officer" who was designated as the "report writer" would be.

Section 3(b) of the executive order stated that "the USDS administrator installed in the Oval Office shall report to the White House Chief of Staff."

The term in the executive order was not a department at the household level of the federal government, but the official name was initially written as United States DOGE Service and the abbreviation was USDS. Reporters repeatedly asked the White House press secretary last week to “identify the USDS administrator,” but the spokeswoman did not respond.

On the 22nd, Musk announced to X that he would exercise his personnel rights, saying, “As per the President’s instructions, all federal government employees will soon receive an email asking them to report on their work performance last week,” and “if they do not respond, they will be considered resigning.”

The 21 employees of Trump's newly created Department of Government Efficiency (DOGE) submitted their resignations en masse on the 24th, saying, "We refuse to use our technical expertise to dismantle critical public services. We swore an oath in the federal government to serve the American people and defend the Constitution. However, it has become clear that we can no longer deliver on that promise." In their resignations, they said, "Many of the DOGE administrators, appointed by Tesla CEO Elon Musk, are political ideologues who lack the skills or experience to make government smaller, cut regulations, and cut costs," the AP reported.
