가자지구의 평균 수명이 1년전 75세에서 40세로 급감하며 ‘이스라엘 대량학살’을 고발하는 유엔 보고서가 나왔고 네타탸후 총리와 루비어 미 국무장관의 회담 직후 15일부터 전면 공격이 시작됐다.

팔레스타인 점령지에 관한 독립 국제 조사위원회는 2021년 유엔 인권이사회에 의해 설립됐고, 유엔 사무국 직원의 지원을 받는 임명된 전문가가 감독하며, 조사위원회는 조사 결과를 인권이사회와 총회에 보고한다.

유엔 조사위원회(COI)의 보고서는 가자지구에서 이스라엘의 Genocide(대량학살)에 대해 국제 협약이 규정한 5 가지 대량학살 행위에서 ▲ 집단 구성원 살해 ▲ 심각한 신체·정신적 가해 ▲ 의도적 생활조건 파괴 ▲ 집단 구성원 강제 이주 등 4개항 자행으로 16일 밝혔다.

국제형사재판소(ICC)지난해 11월 네타냐후 총리와 갈란트 전 장관의 체포영장을 발부했다.

조사 위원장 나비 필레이는 동예루살렘과 이스라엘을 포함한 팔레스타인 점령지에 관한 유엔 독립 국제 조사위원회 위원장으로 가자지구 보건 당국 자료 조사 결과에서 18,000명 이상의 어린이와 거의 10,000명의 여성을 포함하여 64,000명 이상의 팔레스타인인이 사망했으며, 가자지구의 예상 수명은 1년 만에 75세에서 40세가 조금 넘는 수준으로 급감해 인류 기록상 가장 가파른 감소였다고 뉴욕타임스에 기고문으로 16일 밝혔다.

팔레이 위원장은 전 유엔 인권고등판무관이며, 1995년에 남아프리카 공화국의 넬슨 만델라 대통령에 의해 르완다 국제형사재판소의 판사로 재임하며 그가 주재한 사법 재판부는 르완다인 3명에게 대량 학살 혐의로 유죄 판결을 내렸다.

위원회는 조사 결과 팔레스타인인들이 기존 구호 네트워크를 대체한 이스라엘과 미국의 지원을 받는 단체인 가자지구 인도주의재단이 운영하는 배급 장소에서 식량을 찾다가 살해됐다는 사실을 발견했고, 팔레스타인 어린이를 포함한 수백 명이 구호품에 접근하려다가 총에 맞았다고 밝혔다.

팔레이 위원장은 “어떤 사람들은 이스라엘의 전쟁이 계속되는 동안 ‘대량 학살’이라는 용어를 적용하기에는 너무 심각하다고 주장하나 법은 명백하다”면서 “대량 학살을 방지할 의무는 심각한 위험이 명백해지는 순간 발생하고, 그 문턱은 오래 전에 이 전쟁에서 넘어 섰다”고 밝혔다.

2024년 1월, 국제사법재판소는 가자지구에서 ‘대량 학살’이 자행되고 있는 심각한 위험이 있음을 모든 국가에 통지했다.

팔레이 위원장은 “국제사법재판소의 모든 국가 통지 이후로 증거는 더욱 깊어졌고 살인 사건은 배가됐다”면서 “이는 국제사회에 어떤 의미가 있을까? 이는 그 의무가 선택 사항이 아니라는 것을 의미하며, 모든 국가는 대량 학살이 발생하는 곳마다 이를 방지할 의무가 있다”고 밝혔다.

이러한 의무는 대량 학살 행위에 사용되는 무기 및 군사 지원의 이전을 중단하고, 방해받지 않는 인도주의적 지원을 보장하고, 대량 이주와 파괴를 중단하고, 학살을 중단하기 위해 가능한 모든 외교적, 법적 수단을 사용하는 등 조치를 요구한다.

위원장은 이에 “아무것도 하지 않는 것은 중립이 아니다”며 “공모이다”고 밝혔다.

오늘날 국제 사회는 이번에도 가자지구에서 행동에 실패하고 있다. 사실은 매일 보도된다. 경고는 명백하다. 법은 명확하다.

한 민족의 생존이라는 위험은 이보다 더 높을 수 없다.

대량 학살을 방지할 의무는 국가뿐만 아니라 국제 시스템 전체에 속한다.

유엔 안전보장이사회는 양심의 무덤이 되어서는 안 된다.

지역 조직, 국가 의회, 시민 사회 및 일반 시민 모두 정부가 행동하도록 압력을 가하는 데 역할을 한다.

대량 학살 협약은 홀로코스트의 잿더미 속에서 "다시는 하지 말라"는 엄숙한 서약과 함께 탄생했다.

그 서약이 어떤 사람들에게만 적용되고 다른 사람들에게는 적용되지 않는다면 의미가 없다.

나는 모든 정부, 모든 지도자, 모든 시민이 다음과 같이 질문할 것을 촉구한다.

우리의 자녀와 손주들이 가자지구가 불타버린 동안 우리가 무엇을 했는지 물었을 때 우리는 뭐라고 말할 것인가?

모든 대량 학살 행위는 우리를 묶는 인간성에 대한 시험이다.

가자지구 최대 도시에 전면 공격을 시도한 15일에 앞서 14일 루비오 미 국무장관은 네타냐후 이스라엘 총리와 텔아비브에서 기자회견에 참석했다.

네타냐후 총리는 기자회견에서 하마스를 "물리치겠다"고 자신있게 선언하고 평화 협상 추진에 대해서는 어떤 발언도 내놓지 않았고, 옆에 서있던 루비오 장관은 반대나 우려를 전혀 표명하지 않아 ‘가자지구 마지막 총 공격’에 트럼프 체제가 공조를 보였다.

뉴욕타임스는 <트럼프의 자유방임주의 입장은 네타냐후에게 가자지구 확대에 대한 프리패스를 제공한다> 제목에서 <이스라엘이 가자지구에 대대적인 공세를 펼치는 가운데 트럼프 대통령은 자제를 촉구하지도 않고 이 행동을 지지하지도 않았으며, 이스라엘 지도자는 이를 암묵적으로 진행할 수 있는 청신호로 받아들였다>고 16일 보도했다.

NYT는 이어 “이스라엘의 가자지구 전쟁 수행에 대한 국제적 분노가 새로운 절정에 이르면서 트럼프 대통령은 최근 가자지구에서 네타냐후 총리의 전략을 비판하지 않았고 심지어 하마스와의 어떤 거래도 불가능하거나 과거에도 불가능하다고 제안하기 시작하며 지난 7월에는 ‘나는 그들이 죽고 싶어하는 것 같다’고 기자들에게 말했다”면서 “지난달 트럼프 대통령은 이스라엘이 가자지구를 완전히 점령할 수 있다는 생각에 어깨를 으쓱하며 대부분의 서방 정부를 더욱 무시했고, ‘정말 말할 수 없다. 그것은 거의 이스라엘에 달려 있을 것이다’고 말했다”고 보도했다.

루비오 미 국무장관과 회담 후 이스라엘군은 15일 밤새 격렬한 폭격을 가한 후 가자시티를 점령하기 위해 오랫동안 위협해 온 지상 공격을 16일 전면 시작했다.

가자지구에 거주하는 수십만 명의 팔레스타인인이 거주지는 황폐화되었지만 여전히 인구 밀도가 높은 도시 지역에서 피난을 대대적인 피난 행렬이 외신들에 의해 보도되기 시작했다.

스페인 국영 방송사 RTVE의 이사회는 16일 이스라엘이 행사에 참가할 경우 내년 5월 비엔나에서 열리는 ‘2026 유로비전 송 콘테스트’에서 탈퇴하기로 결정했다.

스페인은 네덜란드, 슬로베니아, 아이슬란드, 아일랜드에 이어 다섯 번째로 이스라엘 비토 서약을 했고, 유럽 ‘빅 5’인 영국, 독일, 이탈리아, 프랑스에서 첫 번째 비토 국가가 됐다. 이들 국가는 자동으로 대회의 최종 라운드에 진출할 자격을 얻습니다.

유락티브는 “스페인 공영방송 RTVE는 16일 이스라엘의 참가가 허용될 경우 2026년 유로비전 송 콘테스트에서 탈퇴할 것이라고 발표하면서 가자지구 전쟁을 둘러싼 마드리드와 텔아비브의 분쟁이 고조됐다”며 “의회와 상원이 임명한 RTVE 이사회는 문화 플랫폼이 ‘대량 학살을 정상화해서는 안 된다’고 주장한 어니스트 우르타순 문화부 장관의 압력 끝에 이 결정을 지지했다”고 밝혔다.

15명으로 구성된 이사회에는 사회당이 주도하는 의회에서 지명된 11명과 야당이 장악한 상원에서 지명된 4명이 포함됐고, RTVE는 앞서난 4월 보낸 서한에서 유럽방송연합(European Broadcasting Union)에 이스라엘의 참여에 대해 논의할 것을 촉구했다.

로이터는 방송사의 발표에 대해 “정치적 중립성을 강조하는 유로비전은 올해 가자지구 전쟁과 관련된 논란에 직면해 있다”면서 “여러 국가는 연례 행사를 조직하고 공동 제작하는 공영 방송사 연합인 유럽 방송 연합에 2025년 대회에서 이스라엘을 제외할 것을 촉구했으나 이스라엘 참가자 유발 라파엘은 결국 2위를 차지했고, 올해 우승자인 오스트리아 가수 JJ는 ‘2026년 이스라엘의 배제’를 촉구했다”고 보도했다.

Life expectancy in Gaza drops from 75 to 40, UN report accuses of "Israeli genocide"

A UN report released on the Gaza Strip accusing the Israeli genocide of a sharp drop in life expectancy from 75 to 40 years a year ago, sparking a full-scale offensive on the 15th, immediately following a meeting between Prime Minister Netanyahu and US Secretary of State Louvier.

The Independent International Commission of Inquiry on the Occupied Palestinian Territories was established by the UN Human Rights Council in 2021. It is overseen by appointed experts supported by UN Secretariat staff, and reports its findings to the Human Rights Council and the General Assembly.

The UN Commission of Inquiry (COI) report identified four of the five acts of genocide committed by Israel in the Gaza Strip, as defined by international conventions: killing members of a group, causing serious physical or mental harm, intentionally destroying living conditions, and forcibly relocating members of a group.

The International Criminal Court (ICC) issued arrest warrants for Prime Minister Netanyahu and former Minister Galland in November of last year.

Navi Pillay, the head of the United Nations Independent International Commission of Inquiry on the Occupied Palestinian Territories, including East Jerusalem and Israel, wrote in an op-ed in the New York Times on the 16th that data from Gaza health authorities showed that more than 64,000 Palestinians, including more than 18,000 children and nearly 10,000 women, had died, and that life expectancy in Gaza had plummeted from 75 to just over 40 years in just one year, the steepest decline in human history.

Pillay is a former United Nations High Commissioner for Human Rights and was appointed by South African President Nelson Mandela in 1995 as a judge at the International Criminal Tribunal for Rwanda, where he presided over the judicial tribunal that convicted three Rwandans of genocide.

In his contribution, he wrote, “I understand the word ‘genocide’ and I do not use it lightly. It is a deliberate attempt to destroy, in whole or in part, a people, and this constitutes the most serious violation of our shared humanity and the most serious breach of international law.”

He continued, “Today, the UN Commission I lead is publishing its legal analysis of Israel’s actions in the Gaza Strip, and our conclusion is stark: Israel has committed genocide against the Palestinian people in the Gaza Strip.”

He announced, “These findings are based on extensive evidence and an investigation covering the period from October 7, 2023, when the war began, to July 31, 2025. They are corroborated by multiple sources and assessed within the rigorous legal framework of the 1948 UN Genocide Convention, to which Israel is a party.”

He stated, “Our analysis reveals that starvation has been used as a weapon of war and that the health system has been deliberately destroyed. Maternal health care has been severely compromised, and children have been starved, shot, and buried in rubble.”

He defined this as ethnic cleansing, a form of genocide, saying, “According to UNICEF, a child dies every hour in the Gaza Strip.” “These are not accidents of war. They are calculated acts to destroy a people,” he said.

He wrote, “Establishing genocide requires not only acts but also intent. Here again, the evidence is clear: senior Israeli leaders, including the president, prime minister, and former defense minister, have dehumanized Palestinians.”

As evidence for his findings, he cited Yoav Galant, then defense minister, as saying on October 7, “We are fighting human animals,” and Israeli President Isaac Herzog declared, “The entire Palestinian state is responsible.”

“Their words were matched by actions that made Gaza uninhabitable: indiscriminate bombing, the denial of humanitarian aid, sexual and gender-based violence, and a siege designed to starve the population,” said Commission Chairman Paley. “Together, these constitute a pattern of genocidal intent.”

The commission found that Palestinians were killed while seeking food at distribution sites run by the Gaza Humanitarian Foundation, an Israeli-American-backed organization that replaced existing aid networks. Hundreds, including Palestinian children, were shot while trying to access aid.

“Some argue that the term ‘genocide’ is too severe to apply while Israel’s war continues,” Paley said. “The obligation to prevent genocide arises when a grave danger becomes apparent, and that threshold was crossed long ago in this war.”

In January 2024, the International Court of Justice notified all states of the grave risk of "genocide" being committed in the Gaza Strip.

Chairman Paley stated, "Since the International Court of Justice notified all states, the evidence has deepened and the killings have multiplied." "What does this mean for the international community? It means that the obligation is not optional; all states have a duty to prevent genocide wherever it occurs."

This obligation requires actions such as halting the transfer of weapons and military aid used in genocide, ensuring unimpeded humanitarian assistance, halting mass displacement and destruction, and using all available diplomatic and legal means to halt the genocide.

The Chairperson stated, "Inaction is not neutrality; it is complicity."

The chairman continued, “I do not use these words as an enemy of Israel. I recognize the suffering of the Israelis who lost their loved ones in the horrific Hamas attack on October 7, which killed approximately 1,200 people, and the suffering of the families of the approximately 50 hostages held captive, including approximately 20 believed to still be alive. Our committee has documented Hamas’ crimes.”

He added, “However, no crime, however grave, can justify genocide.”

He specifically stated, “To respond to atrocity with atrocity is to abandon the very values international law was created to protect. History will judge how the world will react.”

In his contribution, the chairman wrote:

<In Rwanda, the international community failed to prevent genocide, and did not intervene to stop it after it began.>

Today, the international community has again failed to act in Gaza. The facts are reported daily. The warning is clear. The law is clear.

The stakes for a people’s survival have never been higher. The duty to prevent genocide belongs not only to states but to the entire international system.

The UN Security Council must not become a tomb of conscience.

Regional organizations, national parliaments, civil society, and ordinary citizens all have a role to play in pressuring governments to act.

The Genocide Convention was born from the ashes of the Holocaust with a solemn pledge to "never again."

That pledge is meaningless if it applies only to some and not to others.

I urge every government, every leader, and every citizen to ask:

What will we say when our children and grandchildren ask what we did while Gaza burned?

Every act of genocide is a test of the humanity that binds us.

Preventing genocide is not a matter of national discretion.

It is a legal and moral obligation, and it cannot afford delay.

The law demands action. Our common humanity demands it.

On the 14th, prior to the attempted all-out attack on the largest city in the Gaza Strip on the 15th, US Secretary of State Rubio attended a press conference with Israeli Prime Minister Netanyahu in Tel Aviv.

Prime Minister Netanyahu confidently declared that he would "defeat" Hamas and made no comment on pursuing peace negotiations. Secretary Rubio, standing next to him, expressed no opposition or concerns, demonstrating the Trump administration's cooperation in the "last-minute assault on Gaza."

The New York Times reported on the 16th, under the headline "Trump's Laissez-Faire Stance Gives Netanyahu a Free Pass to Expand Gaza," that "As Israel launched a full-scale offensive against Gaza, President Trump neither urged restraint nor supported the action, and the Israeli leader tacitly accepted this as a green light to proceed." The New York Times continued, “As international outrage over Israel’s conduct of the Gaza war reaches a new peak, President Trump has recently declined to criticize Prime Minister Netanyahu’s strategy in Gaza and has even begun suggesting that any deal with Hamas is, or has been, impossible, telling reporters in July, ‘I think they want to die.’”

Last month, Trump shrugged off the idea that Israel could completely seize Gaza, further dismissing most Western governments, saying, ‘I really can’t say. It would be up to Israel.’” The Times continued, “President Trump, who has portrayed himself as a global peacemaker and repeatedly called for a halt to the nearly two-year-old Gaza war, now appears content to watch the conflict escalate.”

The Times continued, “Because of the enormous leverage generated by American military aid to Israel, only an American president can slow down Prime Minister Netanyahu, but Trump’s ‘inaction’ amounts to a ‘free pass’ for the Israeli leader.”

After meeting with US Secretary of State Rubio, the Israeli military launched a full-scale ground offensive on the 16th, a long-threatened attempt to seize Gaza City after a night of intense bombing on the 15th.

Hundreds of thousands of Palestinians living in the Gaza Strip fled their homes, their homes devastated, but still densely populated urban areas. Foreign media began reporting on the massive exodus.

The board of directors of Spanish state-run broadcaster RTVE decided on the 16th to withdraw from the 2026 Eurovision Song Contest, to be held in Vienna next May, if Israel participates.

Spain became the fifth country to veto Israel, following the Netherlands, Slovenia, Iceland, and Ireland, and the first from Europe's "Big Five"—the United Kingdom, Germany, Italy, and France—to do so. These countries automatically qualify for the final round of the contest.

The veto motion, proposed by RTVE President Jose Pablo Lopez, received 10 votes in favor, 4 against, and 1 abstention from the 15-member board, Uractiv reported on the same day, citing a statement from the broadcaster.

"The Spanish public broadcaster RTVE announced on the 16th that it would withdraw from the 2026 Eurovision Song Contest if Israel is allowed to participate, escalating tensions between Madrid and Tel Aviv over the Gaza war," said Euraktiv. "RTVE's board, appointed by the parliament and the Senate, supported the decision after pressure from Culture Minister Ernest Urtasun, who argued that the cultural platform should not 'normalize genocide.'"

The 15-member board includes 11 members appointed by the Socialist-led parliament and four by the opposition-controlled Senate. In a letter sent in April, RTVE urged the European Broadcasting Union to discuss Israel's participation.

Reuters reported on the broadcaster's announcement, saying, "Eurovision, which emphasizes political neutrality, has faced controversy this year over the war in Gaza." "Several countries had called on the European Broadcasting Union, the association of public broadcasters that organizes and co-produces the annual event, to exclude Israel from the 2025 contest, but Israeli contestant Yuval Raphael ended up coming in second, and this year's winner, Austrian singer JJ, called for 'Israel's exclusion in 2026.'"
