윤석열 정치안보 국민이 국회 ‘응징’ 헌법파기 ‘극우 테러리스트’

윤석열 대통령 최후 진술이 정치안보로 국민이 국회를 직접 ‘응징’하며 체제전복에 ‘집단 파기’ 방식으로 헌법의 민주공화국 체제 파기하는 ‘극우 테러리스트’를 드러냈다.

윤 대통령은 25일 헌재 최후 진술에서 “자유민주가 무너지는 것을 보고 대통령 출마 때 나라위해 목숨 바치겠다 결심했다”며 “국민들이 국회 망국 독재의 국가위기에 직접 해주고”, “공화국 대의제 위기에 주권자(국민)가 직접 나서달라 호소로 비상계엄 선포했다”고 말해, ‘국민이 국회 응징 체제’로 밝혔다.

윤 대통령은 ‘국민이 국회 응징’에 대한 수단을 ‘정치안보’로 규정하고 “손잡는 일은 절대 해서는 안되는 것”으로 ‘집단적 직접 파기 대상’으로 밝혀 극우 테러리스트의 전형을 드러냈다.

윤 대통령은 진술에서 “비상계엄을 선포한 이유는 오로지 주권자인 국민들에게 국회의 망국적 독재로 나라가 위기에 빠졌으니, 이를 인식하시고 감시와 비판의 견제를 직접 해주십사 하는 것이었다.”며 “공화국의 대의제 위기에 헌법제정권력인 주권자가 직접 나서달라는 호소였다”고 헌법 1조의 ‘대한민국은 민주공화국이다’에 체제 전복 시도를 밝혔다.

그는 이어 “국무회의 배석을 위해 비서실장과 안보실장을 대통령실로 나오도록 했고, 국가안보의 문제이기도 해서 국정원장도 참석시켰다”며 “국방안보만큼 중요한 정치안보이다. 바로 자유민주주의를 지키는 길이다”고 헌법에서 ‘자유민주주의에 입각한 평화 통일 조화 균형 발전’에 전면 파기로 극단적 극우 이념주의로 국가 체제 전복을 밝혔다.

그는 특히 “자유민주주의 국가의 공당이라면 이런 세력을 옹호하고 이런 세력과 손잡는 일은 절대 해서는 안 되는 것”이라며 “선거의 공정과 직결되는 중앙선관위의 전산시스템 보안 문제는 우리 자유민주주의 체제의 핵심 공공재이자 공공 자산을 지키는 일”이라고 ‘헌법의 선거제도’의 ‘관리 독립’을 파기하고 ‘자유체제 수호 종속 기구’로 격하했다.

헌법 114조 ‘선거관리위원회’는 <선거와 국민투표의 공정한 관리 및 정당에 관한 사무를 처리>로 명시해 ‘투표 공정 관리’와 ‘정당 공평 사무’가 원칙이고, 윤 대통령은 이를 ‘자유민주 체제 자산’으로 극우 도구로 변질시켰다.

선거관리위원회에 대해 헌법은 114조에 <위원은 정당에 가입하거나 정치에 관여할 수 없다>라고, ‘이념 관여 금지’를 명시했다.

헌법은 특히 선거관리위원회가 <선거운동은 선관위 관리하에 법률 범위 안에서 균등한 기회 보장>이 분명하게 명시됐으나, 윤 대통령은 이를 ‘자유민주 체제 공공재’와 ‘공공 자산’으로 변조해 헌법의 ‘기회 균등’을 파기했다.

헌법 전문은 <자율과 조화를 바탕으로 자유민주적 기본질서를 더욱 확고히 하여 정치·경제·사회·문화의 모든 영역에 있어서 각인의 기회를 균등>과 1조에 <민주공화국>을 명시해 민주주의 ‘질서와 평화’를 벗어나지 못하게 규정했다.

헌법은 국민에게 8조 ‘정당 설립의 자유’ 24조 ‘법률에 의해 선거권’ 37조 <국민의 자유와 권리는 헌법에 열거되지 아니한 이유로 경시되지 아니한다>고 국민에게 ‘자유’ ‘권리’에 대해 대통령 권한보다 우위에 뒀다.

반면 윤 대통령은 헌재에서 37조를 파기하고 ‘국민들이 국회와 싸우라’고 지시하는 구체적 명령 체계를 만들어 국민을 위험에 노출시키며 ‘국민이 체제 전복 도구’로 전락시켰다.

헌법 7조는 <대통령은 전시·사변 또는 이에 준하는 국가비상사태에 있어서 병력으로써 군사상의 필요에 응하거나 공공의 안녕질서를 유지할 필요가 있을 때에는 법률이 정하는 바에 의하여 계엄을 선포할 수 있다>고 규정해, ‘국가비상사태’로 한정했고, 윤 대통령은 이를 회피하기 위해 ‘정치안보’를 국가안보의 우위에 두는 극우 이념을 동원했다.

윤 대통령의 계엄령 담화문은 처음부터 헌법의 ‘만주공화국’ 파기를 시도해 ‘자유대한민국’으로 국가 정체성을 변경했고, ‘자유대한민국 수호’를 위한 계엄 발동과 ‘자유대한민국의 영속성 유지’를 수십 차례 반복하며 분명하게 직접 밝혀, 헌법이 명시한 ‘민주공화국’ 탈취로 체제전복을 위한 파쇼 쿠데타로 진행됐다.

윤 대통령 게엄 선포 담화에서 “자유대한민국의 헌정질서를 짓밟고”로 시작해 “국회가 자유민주주의 체제를 붕괴시키는 괴물”이라며 “자유 헌정질서를 지키기 위해 비상계엄을 선포한다. 이 비상계엄을 통해 망국의 나락으로 떨어지고 있는 자유 대한민국을 재건하고 지켜낼 것이다”고 ‘체제전복’ 파시즘 쿠데타‘로 지난해 12월 3일 선포했다.

윤 대통령은 담화에서 “자유대한민국 헌법 가치를 믿고 따라주신 선량한 국민들께”와 “자유대한민국의 영속성을 위해 부득이한 것”이며 “대통령으로서 오로지 (중략) 자유 대한민국을 지켜낼 것”을 통해, ‘국시 변경’을 쿠데타 완료 시점으로 밝혔다.

‘테러’는 사전에서 <정치적인 목적을 위하여 조직적ㆍ집단적으로 행하는 폭력 행위. 또는 그것을 이용하여 정치적인 목적을 이루려는 주의>로 규정한다.

Yoon Seok-yeol, Political Security, Citizens ‘Punish’ the National Assembly, ‘Extreme Right Terrorist’ Who Destroys the Constitution

President Yoon Seok-yeol revealed himself as an ‘extreme right terrorist’ who directly ‘punishes’ the National Assembly through political security and destroys the democratic republic system of the Constitution by ‘collectively destroying’ the system.

In his final statement to the Constitutional Court on the 25th, President Yoon stated, “I decided to sacrifice my life for the country when I ran for president after seeing the collapse of liberal democracy,” and “I declared martial law by appealing to the people to directly take action in the national crisis of the National Assembly’s dictatorship that ruined the country,” and “I asked the sovereign (the people) to directly step forward in the crisis of the representative system of the republic,” revealing the typical example of an extremist terrorist.

President Yoon defined the means of ‘citizens punishing the National Assembly’ as ‘political security’ and revealed that “joining hands is absolutely unacceptable,” revealing that he is a ‘target of collective direct destruction’, revealing the typical example of an extremist terrorist.

In his statement, President Yoon stated, “The reason I declared martial law was solely to ask the sovereign people to recognize that the country is in crisis due to the National Assembly’s destructive dictatorship and to directly exercise oversight and criticism.” He added, “It was an appeal for the sovereign people, the constitutional authority, to directly step forward in the face of the crisis of the representative system of the republic.”

He revealed an attempt to overthrow the system in Article 1 of the Constitution, “The Republic of Korea is a democratic republic.” He continued, “I had the Chief of Staff and the Director of the National Security Office come to the President’s Office to attend the State Council meeting, and I also had the Director of the National Intelligence Service attend because it is a matter of national security.”

He added, “Political security is as important as national defense and security. It is the way to protect liberal democracy.” He declared an overthrow of the national system with extreme right-wing ideology by completely destroying the “peaceful unification, harmony, and balanced development based on liberal democracy” in the Constitution.

He specifically said, “If you are a public party in a liberal democratic country, you should never defend or join hands with such forces,” and “The security of the computer system of the Central Election Commission, which is directly related to the fairness of the election, is a matter of protecting the core public goods and public assets of our liberal democratic system,” thereby destroying the “management independence” of the “election system of the Constitution” and downgrading it to a “subordinate organization for the protection of the liberal system.”

Article 114 of the Constitution stipulates that the “National Election Commission” “should handle the fair management of elections and referendums and political party affairs,” and thus the principles are “fair management of voting” and “fair political party affairs,” and President Yoon has transformed this into an extreme right-wing tool as an “asset of the liberal democratic system.”

The Constitution specifically clearly states that the National Election Commission “guarantees equal opportunities for election campaigns within the scope of the law under the management of the National Election Commission,” but President Yoon destroyed “equal opportunities” by making it a “public good of the liberal democratic system” and a “public asset.” The preamble of the Constitution states that “the basic liberal democratic order based on autonomy and harmony will be further solidified to ensure equal opportunities for all in all areas of politics, economy, society, and culture,” and Article 1 states that it is a “democratic republic,” preventing it from deviating from the “order and peace” of democracy.

The Constitution places the people’s “freedom to establish political parties” in Article 8, “the right to vote as provided for in the law” in Article 24, and “the right to vote as provided for in the law” in Article 37, which states that “the freedom and rights of the people shall not be disregarded on the grounds that they are not enumerated in the Constitution,” placing the people’s “freedom” and “rights” above the president’s authority. On the other hand, President Yoon destroyed Article 37 in the Constitutional Court and created a specific command system that instructed “the people to fight the National Assembly,” exposing the people to danger and turning “the people into tools for overthrowing the system.”

Article 7 of the Constitution stipulates that “the President may, in times of war, incident, or other national emergency, declare martial law in accordance with the provisions of law when it is necessary to respond to military needs by using military force or to maintain public peace and order,” and thus limited it to a “state of national emergency,” and President Yoon mobilized an extreme right-wing ideology that placed “political security” above national security to avoid this.

President Yoon’s martial law speech attempted to abolish the “Manchurian Republic” of the Constitution from the beginning and changed the national identity to the “Free Republic of Korea,” and clearly stated the declaration of martial law to “protect the Free Republic of Korea” and “maintain the perpetuity of the Free Republic of Korea” dozens of times, and thus carried out a fascist coup d’état to overthrow the system by seizing the “democratic republic” specified in the Constitution.

In President Yoon’s martial law declaration speech, he started with “trampling on the constitutional order of the free Republic of Korea,” and declared that “the National Assembly is a monster that is destroying the free democratic system,” and “in order to protect the free constitutional order, I declare martial law. Through this martial law, we will rebuild and protect the free Republic of Korea, which is falling into the abyss of national ruin,” and declared it a “fascist coup d’état to overthrow the system” on December 3 of last year.

In his speech, President Yoon stated that “to the good people who believed in and followed the values of the constitution of the free Republic of Korea,” “it was inevitable for the sustainability of the free Republic of Korea,” and “as president, I will solely (omitted) protect the free Republic of Korea,” and revealed the “change of the national policy” as the point at which the coup d’état was completed.
